GTA killer case clears hurdle (BatJack update)

Alabama suit against gamemakers and retailers proceeds as state's top court denies appeal; Jack Thompson promises case will "destroy Rockstar."

The jostling for position continues in the civil suit that pits the estates of killed cops Arnold Strickland and Leslie "Ace" Mealer of Fayette County, Alabama, against the makers and sellers of Grand Theft Auto: Vice City.

In a criminal case that made national headlines in 2003, carjacker Devin Moore, in police custody at the time, grabbed one of the arresting officer's guns and shot and killed that officer and two others. Moore later told investigators, "Life is like a video game; everybody has to die sometime."

Moore admitted to playing Vice City, which is published by Rockstar Games, prior to the killings, and was later convicted of murder. Shortly before that conviction, a civil lawsuit was brought against Sony, Rockstar parent Take-Two Interactive, Wal-Mart, and GameStop on behalf of two of three officers' estates.

In a decision handed down last week and first reported by the Associated Press, the Supreme Court rejected an appeal by the defendants to dismiss the case. That decision keeps alive the $600 million lawsuit blaming the publishers and retailers for contributing to the actions of Devin Moore back on June 7, 2003.

The Supreme Court justices issued their decision without comment, letting the case proceed to trial. The court did, however, open the door for additional delays or dismissal as it agreed to hear claims that the Alabama court lacks the power to hear the case, according to the Associated Press.

Florida attorney and antigame activist Jack Thompson, who penned the original complaint with fellow attorneys Patrick Gray and Raymond Reiser, told GameSpot today he expects the ongoing litigation to both "destroy Rockstar [Games]" and "change the face of the entertainment industry."

Thompson removed himself from the case in November, 2005, after defense attorneys asked Fayette County circuit judge James Moore to remove the lawyer for violations of legal ethics.

A defiant Thompson today said, "I am counsel for all of the plaintiffs, they are still my clients, I was the one who won the First Amendment argument in the hearing on November 3, 2005, which trial record was what was appealed to the Alabama Supreme Court, and I fully expect to be in the courtroom trying the case when it is tried." For what it's worth, I fully support the legal work of Jack Thompson aka BatJack aka Jackpeace. I support suing Walmart because they sold this game that some guy played and who later killed someone. In fact, I don't think Jack has sued enough people. I am sure that the guy also watched the simpsons at some point in his life. Jack should sue Matt Groening and Fox as well. I love Jack. It is a good thing that I do love and support him so that I don't have to worry about getting sued by him.

I personally have put many hours into this Grand Theft Auto game and have yet to kill anyone. But if I do I'm suing Jack Thompson (for giving GTA free press), Walmart (for selling it to me, they should have known better), Rockstar, Remmington (for making a tool they new I was going to use to kill someone), and General Motors (for making a vehicle so nice I had to carjack it). I'll probably sue the cop I killed to, for standing between the gun in my hand and the bush I was firing it into, causing excessive emotional distress.

I was actually one of the few people I know who played the original on PC. That was a great game... where you put in your own CD and tuned the channels of the car you were in to it. I found that Ozzy "Diary Of a Madman" played very well with the different channels. Anyway, despite certain quirks, I thought that first one was the best.

LOL Good one!

But I have to say my views on conducting warfare have indeed been influenced by my gaming experiences. There are no prisoners, there are no noncombatants - there is only VICTORY. ;-D

My older boy got kicked off the Battlefield 2 server the other day for fragging some poor sucker 17 times in a row - with a machete. He got kicked off because they thought he was a hacker-cheat.

I'm all for justice, but, who did the left blame before there were video games? like, back in the Old West? I mean, what kind of negative things were those criminals exposed to? lol.

If anything, video games like this should be viewed as a way of relieving stress, much like a punching bag. Or maybe they would like to outlaw those too.

HB 257 passed overwhelmingly (56-8) by a vote in the Utah House of Representatives. The bill adds violent games to the Child Pornography law. It will now be a felony for an adult to provide a minor the Grand Theft Auto video game.
