WASHINGTON -- A lawyer for Rep. Cynthia McKinney, the Georgia congresswoman who had an altercation with a Capitol Police officer, says she was "just a victim of being in Congress while black."

McKinney awaited word Friday on whether she would be charged for apparently striking the officer after she entered a House office building this week unrecognized and did not stop when asked.

Two law enforcement officials said it was unlikely a warrant would be issued this week. They spoke on condition of anonymity because they were not authorized to speak publicly.

Her lawyer, James W. Myart Jr., said, "Congresswoman Cynthia McKinney, like thousands of average Americans across this country, is, too, a victim of the excessive use of force by law enforcement officials because of how she looks and the color of her skin."

"Ms. McKinney is just a victim of being in Congress while black,"

Yes, that's a change in hair style in that pic.

Before she played the race card she played the hair card.

If she and her attorney consider her a victim of the Capitol Police, maybe we should call for the abolishment of the Capitol Police and let the Congresscritters be responsible for their own safety.

It is a demonstrable tendency that people have a difficult time recognizing people of races other than their own. This is true of all races. People should be congnizant of this fact, instead of assuming a racist motivation.

The same way she was a victim when she pushed someone out of the way when they tried to stop her from taking a friend and children into a closed hearing? No, McKinney is a repeat offender and needs to be arrested.

McKinney admits she was not wearing a pin identifying her as a member of congress.

No ID? No one should be allowed in the Capitol without an ID present - period. In my office building that is the rule. She should have been forced to stand at the guard's desk and have someone sign her in or go home and get her ID. And this is if she hadn't struck the officer.

Now considering she further did not explain who she was politely, evaded an officer and then struck the officer, she should have been cuffed and detained.

There should be zero tolerance for stuff like this at the Capitol. Entry should not be based solely on appearance since a terrorist lookalike could pose as a Congressman. All entry should be based on having a verifiable physical ID credentials.

They need to make an example out of her.

And furthermore - how can security procedures at the nation's Capitol be more lax than my office building?

I have agreed to try to remember to wear my pin and to notify Capitol Hill police every time I change my hairstyle.

Channel 2 Action News has learned that Rep. Juanita Millender-McDonald (D-CA.) intervened when word got out Wednesday night that McKinney might be arrested.

She says she approached the House sergeant-at-arms to discuss the situation.

Millender-McDonald sits on the House committee that oversees the Capitol Hill police and the sergeant-at-arms' office.
