Article I, section 6: Discussing senate and house members: They shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same; and for any Speech or Debate in either House, they shall not be questioned in any other Place. I think that means she can't be issued an arrest warrent during the session for a misdemeanor. Note this is also the clause the says that if a senator leaks classified information on the floor of the house or senate, they cannot be prosecuted for it, except by the senate or house itself, which can do no more than expell the member. Which is why every congressman or senator could read the entire Barrett report into the record. The judicial branch CAN'T forbid them from seeing the report, and they can't constitutionally act to punish them for speaking in session. It also explains why nobody has done it though -- unless you KNOW a majority in the body will fight for you, you risk punishment within the body.

I've looked over this thread, and can't believe what I'm not seeing. Not one single person has pointed out the obvious. This is a blatant attempt by Dick Cheney to have McKinney ousted from office. He hired the guard, he put him there at that time, with specific instructions.

BUSH KNEW!

Thanks for the Constitutional discussion. My first smart-assed reaction when I saw it was shusssssss...most current members of Congress are clueless about what's in the document they are sworn to protect and defend. Don't wake them up now when McKinney is fixin' to have her butt arrested. However, I revere the Constitution too much to give in to my baser instincts.

The question revolves around how "session" is defined. Both houses of Congress get to make their own rules. Somewhere buried in the House rules, I would assume there is a definition of "session." Is it the broad two-year term of office for members? Or is it more narrowly defined as when there an active session occurring on the floor of the House? If it's the latter, and the House had not been gaveled into the daily session, then she can be arrested.

It's a good thing that Cindy Sheehan McKinney isn't on the lam from her assault and moonbattery warrant. I don't even want to think of her photo on the wall in every U.S. Post Office.

It would cause everyone in the building to go postal and trigger panicky stamp-edes.

I would at least expect her to be censored in the House. I do not believe that she will be criminally prosecuted for this. The Jessie Jackson Race card (get out of jail free card) is about to be used.
