Judge Won't Drop Charges in Mosque Sting

ALBANY, N.Y. (AP) - A federal judge refused to dismiss charges against two Muslims arrested in an FBI anti-terrorism sting, rejecting claims that evidence was tainted by use of illegal warrantless wiretaps.

U.S. District Judge Thomas McAvoy's ``classified'' order leaves secret his reasons for also turning down defense requests to suppress any evidence acquired from warrantless wiretaps or force authorities to disclose whether they were used in the Albany case.

His three-sentence public order was issued late Friday.

Yassin Aref, 35, an imam at Masjid as-Salam in Albany, and Mohammed Hossain, 50, are accused of laundering money in 2003-2004 for an FBI informant, a Pakistani businessman posing as an arms dealer. Neither is accused of actual violence.

Both deny charges that they conspired to provide support to Jaish-e-Mohammed, a Pakistan-based group listed by the federal government as a terrorist organization. Aref remains in jail awaiting trial, while Hossain is free on bond.

Defense has no idea if wiretaps were even used. And if they were used, warrantless does not equal unreasonable.

APuke: supprting a terrorist organisation is "not actual violance"

Perhaps Saddam Hussein also did nothing "actual violent". Maybe he isn't so bad after all...!

You must need some sort of a warrant to even start a sting so wouldn't wiretaps be an automatic part of it? I would think.

Hmmm... but wouldnt it be scary if you DIDN'T need a warrant to do any of this?

What sucks is that because of these islamofascists, civil liberties are being eaten away.. piece by little piece.

Pity. But the world has changed.

You got some of your civil liberties back when the reformed patriot act came back. Everyone said things will change right after 9/11. You need to get your resolve back. This is how its going to be for awhile. Yes we are at war with islamofascists and I don't think we are doing enough to get it done. This is whats wrong with Bush's pole numb. being down, people are losing their resolve.

Memo to the Associated Press:

Financing international terrorism would never have a "cause and effect" on "actual violence," now would it?

The reason why I loathe the AP and Reuters is because their reports give aid and comfort to the enemy.

Thomas J. McAvoy is a United States District Judge for the Northern District of New York. At the time of his appointment in 1986

Looks like a Reagan appointee.
