I agree- they pocketed the $5,000.00 and never referred the case to the prosecutors office for "theft by deception" which is the law that was violated. They came after me instead. Nice Huh?
Can you sue the town for that? This doesn't sound legal to me.
The contractor was proven guilty. Now you have become the victim of the crime PLUS the town.
