It was a beautiful moment and full of honor even in its sadness. I just turned 17, and being made a honorary member of the Vets who had an agreement with my High School for me to be excused for this honor. Those were the real patriots. We are probably talking about a person who interprets "...the right of the People to keep and bear Arms shall not be infringed." as meaning "the government has total say over who may and may not own those icky guns."
Or maybe he is just worried that this law may prohibit what happened at funerals like Wellstones or Coretta Scott Kings.

Remeber most full time law professors are refugees from the legal profession because they can't hack the real world.
"without question violates the First Amendment" which guarantees the right to speak freely and to assemble.
The law doesn't prohibit it, just says you have to do it 500 feet away. Sounds reasonable to me.

Do we really need a law for everything. Are we not able as men to handle anything on our own. Are there any men left here. Or are they all fighting elsewhere in the world.
The solution is simple. If some one comes to a funeral to insult a service honoring a fallen hero, you beat them to a bloody pulp. Problem solved.
That's still the way it is handled in the Deep South where I live. I suppose that is why those kinds of things don't happen here. If you insult someone, they'll beat the crap out of you. If they take you to court, the judge will laugh it them. You pay the $50 fine. Justice is served. The old fashion way. The manly way. The American way.
I agree with the prof. As much as I hate the protestors in question, I don't think that the law will stand up to judicial review.
There is more to it than that. If it is private property there is no right to even be there.
How about a law that allows citizens to tar and feather the phelps phools, then ride them out of town on a rail.
