Student settles over Confederate dress

LEXINGTON, Ky. (AP) - A former high school student barred from her prom because she wore a dress styled as a Confederate battle flag has reached a settlement with the school district, her attorney said.

Jacqueline Duty filed a lawsuit after Greenup County school officials called the dress too controversial and kept her out of Russell High School's May 1, 2004 prom.

Duty claimed the district violated her First Amendment right to free speech and to celebrate her heritage.

School officials notified the U.S. District Court last week about the settlement. Duty's attorney, Earl-Ray Neal, confirmed a settlement had been reached but said the terms will not be disclosed.

The settlement must be approved by the judge, Neal said.

I'd like to hear of some enterprising young student wearing the Confederate flag into the school just to test exactly what that settlement was.

Funny, I see the "African" flag everywhere. Is that the flag of the entire continent of Africa?

As I view the Atlas, I see the continent of Africa comprised of individual nations.

I do not see, read or hear of the banning of the "African" headress, caps, shirts or any other piece of fabric or clothing worn.

This girl should have the same freedom to wear what she pleases, to the prom, the mall, or waltzing merrily down the street.

I'm amazed at the myopic view of those that claim to embrace the Constitution, and then resort to empty posts such as yours.

You are obviously quite intellectualy deficient, have no knowledge of the south and are expedient in your response, but lack weight in your judgement.

Is it illegal?

I suppose a "see through" bodice would have been okay with you.

I hope they pay for her college education.

I sincerely hope the school board gets punished and will never do this stupidity again.

Nothing against celebrating heritage, but a prom is not the time nor the place.

And as her parent, who is also footing the bill, you would have the right and the responsibility to tell her NO. But the school officials did not have that same right or responsibility, as long as the dress provides adequate covering as to not produce indecent exposure.

I thought that was the whole point of a prom dress no matter what the specific style chosen. They are SUPPOSED to say "Hey everybody! Look at me!". It's a prom. As in "promenade" as in something you do so people can look at you. Otherwise there's no point in dressing up for it.

Your reply is a cunard. Are you a mind reader? You're assuming unto yourself the ability to discern that which led this young lady to wear this particular dress.

Perhaps, she simply liked the way it looked.

As for your "get a life" statement, that's so sophomoric.

Perhaps Goldwater was being sensitive when he stated, "Extremism in the defense of liberty is no vice."

After applause, Goldwater further said, "And let me remind you also that moderation in the pursuit of justice is no virtue."
