New laws allow some states to tax drivers annually -- even if they live in another state -- simply because they received a speeding ticket. One Connecticut motorist, who asked that his name not be used, discovered this after driving in October in Niagara Falls, New York. Despite being caught in what he considered a brazen speed trap -- the speed limit was 45 MPH where he was caught, but 55 MPH at the same location in the opposite direction -- he accepted the $155 fine for driving 72 MPH thinking by paying the matter would be settled.
Last week, however, the state of New York notified him that it now considers him an "at risk" driver and therefore he must either pay the state an annual $100 tax or a lump sum of $300.

How can you be subject to the jurisdiction of a state you don't live in and aren't in?
Isn't this additional punishment without due process?

And what good would that do? It seems to me that a jurisdiction can set the speed limit on any particular stretch of roadaslow as they wish...as long as that limit is clearly marked or is clearly set out in state law (e.g. 30 MPH speed limit in all "built-up areas").
My business used to be in Connecticut.
I had to collect sales tax for Connecticut, Massachusetts, Rhode Island and New York for anything I sold to my cusotmers in those states. And if I was a little slow, like 2-4 days in sending in my reports, they got REALLY upset.
Moved to Florida and still sell to those customers but no longer collect any taxes.
Can't we just declare war on New York state, invade it, take it over, and start all over again?
OH PLEASE, could you? You can push NYC out to sea and pull the plug and then have the first causalty-less war. The libs, who would be the most likely to object, have conveniently disarmed themselves already.

I would be very interested in the outcome of such a test case.........I just don't want to be the test :)
Unless they do the same to the in state drivers this will
not stand due to the "equal protection clause" of the constitution.

i've been pulled over a dozen times for speeding (most on I40)recieved two tickets and ten warnings. the two tickets i was doing 80 in a 55 (it was 65 outside of town) they wrote me up for 72 each time. can't be a coincidence. went to class to get tickets erased the stories the others told and problems people create by being rude or doing 70 in a 25 school zone construction zone. i was the only one who got the speed reduced. a bunch ended up with other offenses. the other 10 i was doing 65 in 55. Had the cruise set each time. What's my secret ... pullover immediately, put flashers on, turn off motor, leave hands on the wheel until he tells you otherwise, give the officer room to stand safely next to your vehicle, be polite, have your license, insurance, and registration, admit that you were speeding, and say sorry. the last couple warnings I've even asked the officer if he was sure. worked for me. oh and i'm a guy.

This is blatantly taxation without representation. A court challenge should get rid of it and stop others in their tracks.

Kind of like this - Ohio has a law that says vehicles must have a license plate on the front and back of the vehicle. Michigan only gives us one plate for the back. Several years ago I got pulled over in Ohio and was given a ticket for not having a plate on the front of my car. When I argued that I couldn't possibly have a second plate because Michigan didn't issue them, I was told "Too bad - we do"!""
Please tell us that you fought this and that legislatures in those 2 states have gotten the message.
I cannot create a second license plate if my state doesn't issue one- that would be forgery, wouldn't it?
This is just plain stupid. Is this the best that our politicians can do???
And if he doesn't pay? Then what? The most they could do is suspend his right to drive in NY.
Which, to me, sounds like a win-win scenario.
