What Senator Duane does in the privacy of his bedroom is his business, but using his public office to discriminate against the Boy Scouts for disagreeing with his views is a betrayal of public trust.
Just as he has a right to his point of view, the Boy Scouts (a private, non-profit organization) has the right to theirs.

Who would have ever thought they'd see the day when a Senator condemns the Boy Scouts of America and calls for them to be banned from their Govenor's mansion. It's almost unbelievable. And to think that these people are wondering why they can't seem to win the heart of America.

The question is whether an organization's discrimination is unfair. The Supreme Court has ruled it's not. No the Supreme Court ruled that the Boy Scout's discrimination was legal. Whether or not the discrimination is fair or unfair depends on one's point of view.
