Absolutely he has. The Congress cannot take away a power that is given to the President under the Constitution. The President has the sole power to "CONDUCT" war a foreign affairs (not the Clinton kind!). Congress declares war, but an attack on the US does not EVER require the President to obtain a declaration of war to respond with his full powers as Commander & Chief. Furthermore, Congress has no say in how the defense of the country occurs other than the purse strings.
The 4th Amendment only prohibits an unreasonable search and does not require a warrant. President must only comply with what the 4th Amendment requires, not some law passed by Congress that attempts to upsurp his Constitutional powers. The law passed by Congress to create the FISA Court and require a warrant is such a law. President can conduct any wire tap for national security and defense without a warrant so long as the search was reasonable. Probable cause is met when there is reasonable suspicion the call involves a terrorists, PERIOD! As an example - Does a policeman have to get the judge to give him a warrant to arrest you if he has reasonable suspicion you committed a crime? Hell NO! The policemen is simply an official of the executive branch - ie an agent of the President. So if the police officer does not need a warrant, why does the President?
Answer - Obvious the President does not.

The Dems linking their future to Al Quida as a Party? While there have been flirtations with the communists before, they weren't in entire agreement there.
I am convinced that the Democrats' ecstasy over the blockage of Social Security reform is rooted in their socialist desires. Some "lesser" Dems may be foolishly chugging along thinking that the strategy is anti-Bush. The "bigger" Dem threats (Hillary, Biden, etc), however, want to bring about a crash of Social Security in order to crush us all into a dependency class, over which they control the reins.

Revealing the number of applications would have disclosed the fact there was such surveillance..It was secret until the NYT leaked it..Schumer knew that and Gonzales must be tired.
