I thought it was odd that he brought it up too. I'm trying to remember various exchanges from that hearing given this news and what I keep coming back to is Rockefeller's last statement, which followed Roberts odd comment

I thought I had recorded over the hearing that I taped .. but I still had the end of it

Roberts comments came after DiFi's questioning

Roberts kept talking about the committee and (9/11) investigations under previous leadership and independent staff .. which I believe would be Rockefeller

Also .. after Roberts tried to end the hearing .. Rockefeller chimmed in and wanted to respond .. and in the middle of Rockefellers lecture about following the law because the law is the law .. Roberts left the hearing before jay finished talking

Didn't Rockefeller also ask if the program was covert?

Yes he did .. he asked if it was a covert action as defined by the National Security Act

Negroponte answered no and then Rockeller said that was what they were told by the Justice Department yesterday

Thanks for checking that out. That's how I remembered the sequence and I also remember Rockefeller sounding really funny, his voice had that tone one gets when something is very personal. (But I haven't seen enough of him to actually know if that isn't how he always sounds.)

What do you make about his question regarding the covert status? Was he trying to defend the leak because it wasn't covert?
