SARAJEVO, Feb 2 (Reuters) - A Bosnian Serb war crimes suspect whose wife was killed in a shootout with European Union soldiers during his arrest in January is to go free on a legal technicality, Bosnia's state court said on Thursday.

For the moment, Dragomir Abazovic is still in hospital because he shot himself in the head during the operation, in which his 11 year-old son was also wounded, allegedly while firing back at EUFOR troops along with his mother.

Abazovic was indicted in 2002 for war crimes against Muslims in his home area of Rogatica in eastern Bosnia during the 1992-95 war.

A spokeswoman for Sarajevo University's Clinical Centre said he was no longer under police guard.

"Technically, he could walk out today. But the doctors planned to release him on Friday," hospital spokeswoman Biljana Jandric said. "He's eating normally and going to physiotherapy."

The European Union Force (EUFOR) said Abazovic shot at its troops when they approached his home then fled and shot himself as soldiers closed in. His wife and son, meanwhile, fired four full clips from a Kalashnikov to keep EUFOR at bay, it said.

Abazovic's son, who was shot in the stomach by a EUFOR soldier, denied the peace force's version of the incident.

The court said Abazovic was arrested on a old warrant that was no longer valid because Bosnia had since established its own war crimes court and relevant legislation.

"Since the state court took over the case in July 2005, the Criminal Procedure Code of Bosnia and Herzegovina is the relevant law in this matter," spokesman Dino Bjelopoljak said. (Additional reporting by Maja Zuvela)

Remember one month ago when EU stormtroopers attacked family in Bosnia, and said that wife and 11 years old son fiered foue clips from AK-47 on them, so they hade to shoot the, killing wife and than father shot himself in forehead and surrvived it?

Well, after all, war crime indictment is outdated.

In my life I never saw thing like that warcrime suspect get out on technicality.
Obviously, something wasweeeeeery much f*cked up!

He wasn't even wanted by the ICTY, but the local Muslim-run court. So, this shows that EUFOR is acting for the Muslims in addition to the UN court. The Europeans and the U.S. are very pro-Muslim rights and oppression in others' backyards.

About time! As for EUFOR-----sounds like a fascist troops under Leaky working for the local fascists and moderate Muslims are saying that too!

"The weekly Slobodna Bosna (Free Bosnia), whose editor is Senad Avdic, a moderate Muslim, in its latest issue described in detail how and where the alleged terrorist camps operate in Bosnia. The paper criticised the commander of the international forces in Bosnia (Eufor) David Leaky for his recent statement that he had no knowledge of the existence of such camps."
