Backed by abortion rights groups, three Massachusetts women sued Wal-Mart on Wednesday, accusing the retail giant of violating a state regulation by failing to stock emergency contraception pills in its pharmacies.
The lawsuit, filed in state court, seeks to force the company to carry the morning-after pill in its 44 Wal-Marts and four Sam Club stores in Massachusetts.
The plaintiffs argued that state policy requires pharmacies to provide all "commonly prescribed medicines."
Wal-Mart carries the morning-after pill in Illinois only, where it is required under state law, said Dan Fogleman, a spokesman for Bentonville, Ark.-based Wal-Mart.
Fogleman said the company "chooses not to carry many products for business reasons." He would not elaborate. But in a letter to a lawyer for the plaintiffs, a Wal-Mart attorney said the store chain does not regard the drug as "commonly prescribed."
CVS, the state's largest pharmacy chain, stocks the pill at all of its drugstores.
Headline should read: "Liberal nutcases sue Walmart"
"The plaintiffs argued that state policy requires pharmacies to provide all "commonly prescribed medicines.""
How is that constitutional?
And the stampede out of Massachusetts continues.....
Yes. I simply cannot believe people are suing to force a private business to stock certain products.
I believe it was Sylvia Plath that stated. "All women love Fascists."
Odd, I thought liberals wanted to keep the government out of private decisions? Or does that only apply when the private decision is whether or not to kill an unborn baby?
Truth is sometimes stranger than fact.
Truth is sometimes stranger than fiction.
Screw these crybabies. On second thought, don't.
EMERGENCY CONTRACEPTION PILLS????? What's the emergency, that the baby may actually live????
What? You mean these activist types actually shop at Wal Mart?!
Shame on them!
McDonalds also does not sell the pills. What is the actual damage to these woman - are they now pregnant? Can the pills be bought down the street from a different vendor? Why is there not a male plaintiff involved in the lawsuit?
these women were free to find a drug store that stocked them. more stupid lawsuits. walmart should be able to decide what drugs they want to stock and what they dont. i remember when drug stores had signs up saying they wouldnt stock oxycontin for fear they would be robbed. did they get sued too?
Go to freakin' Walgreens you bums. I love how liberals sue because people try to tell them how to live their lives. Then, they sue because others don't do things just they way they want them done. What a bunch of hypocrites. It makes me so mad I could spit when these groups can't accept that some of us have the God-given right to disagree with them.
The arrogance and elitism of these people is disgusting. They are mental midgets and hateful.
OOOPPS....guess it was worth saying twice.
"Since when does Wal-Mart have to sell anything?"
I believe most States regulate pharmacies, but you're correct, they could simply close their pharmacy doors.
