Reid Concedes Dems Lack The Votes

Reuters reports Senate Minority Leader Harry Reid said Democrats lack the votes to block Judge Alito's confirmation:

"Everyone knows there is not enough votes to support a filibuster," Reid said, referring to the procedural roadblock that some Democrats wanted to use to put off a vote on Alito.

Even after Senators Feinstein and Reid flipped flopped and decided they would now support Kerry's filibuster against Alito, there are still seven Democratic Senators who have said they will not support a filibuster against Alito's confirmation:

Akaka
Biden
Conrad
Dorgan
Durbin
Landrieu
Pryor
Salazar

Then there are the three Democrats who have announced they will vote for Alito's confirmation - Byrd, Johnson and Ben Nelson.

No Republican senator will support Kerry's filibuster. Even the two Republicans that haven't revealed whether they will vote for Alito's confirmation, Chafee and Snowe, say they will oppose a filibuster.

According to the Boston Globe , Kerry won't find more than 30 votes:

But high-ranking Senate aides said the best Kerry and Kennedy can hope for is to persuade 25 or 30 Democrats to sign on -- well short of the 41 votes they need to lock in unlimited Senate debate and kill the nomination.

Reid said he would support Kerry's filibuster "to at least send a message." Sadly, the message is that the Democrats are obstructionist sore losers.

I don't like this filibuster business.

The dems are going to do a lot of harm to everybody with this.

What I find preposterous is the number of Democrats admitting the folly of a filibuster, yet they say they will still vote for the filibuster.

After a three month long nomination process, Judge Alito is now on the one yard line, ready to be confirmed and there is a big whole in the Democrats’ goal line defense. I’d like to once again thank Senator Specter for quarterbacking Judge Alito’s nomination process thus far. I hope those who know Judge Alito best come out in full strength tomorrow and Tuesday, and once again reiterate the breadth of qualifications and experience that define Judge Alito.

"Everyone knows there is not enough votes to support a filibuster," Reid said

Obama of ILL has stated that there aren't enough votes. He sees the writing on the wall and is smart enough NOT to go over the cliff with the far-left-wing lemmings.

Plus, I thought someone who had been a federal judge was barred from returning to the practice of law, although I may very well be wrong on this.

You are.

Which one, am I right or wrong?

Wrong. Not only is there nothing prohibiting former judges from returning to private practice, but there are also specific ethics rules for former judges who do so.

Here's predicting the Rats get 35 for the filibuster, give or take a couple.

As for Durbin and Salazar, I would not take ANYTHING they say to the bank, if it's something reasonable like not supporting the filibuster.

Boo hoo. And just imagine Bush having one more chance at the Supreme Court. A joyous thought.

Stevens or Ginsburg is probably going to drop next. Replacing one of them with one of ours will be major. I just hope the president has the backbone to go for it, and not put a leftie up there to maintain balance or whatever.

From Daily Kos, the Moonbats who are driving this thing:

We support extended debate on the nomination of Samuel Alito to the Supreme Court of the United States because it is the right thing to do.

Total BS, pretending that your filibuster attempt is merely for "extended debate". Thats not your goal, you goal is to derail Alito, no matter what he says.

Why do they even try to hide behind this "extended debate"? Errhead Amerika shows and most DUmmies posts openly state that "Alito is not right for Amerika" and "we are going to lose our Amerika the way we know it, if Alito is confirmed." They (LLL) are telling anyone who will listen to phone, fax, and e-mail the Senators to get this derailed. There is no request for extension of debate. Period.

"If it weren't for the threat of the Constitutional option, a whole lot more Democrats would be voting for a filibuster."

I think the Gang of 14 agreement insures that those 7 dems of the gang will not vote to sustain a filibuster. They can't make a case for extraordinary circumstances for this nominee. If enough of the gangs' democrats did break the agreement and vote against cloture, this would probably give the republicans of the gang enough incentive to vote for the nuclear option. I think the nuclear option will not be needed now, but it is still in the arsenal.

But if they do filibuster, wasn't the deal made once that if they try to filibuster, Frist will invoke the nuclear option and they can never do it again? I read somewhere that the Dems were worried about this and if it was worth a filibuster knowing this would be the last time they could use it.

I think Obama wants to run for the presidency one day and wants to be taken seriously when that time comes. Obviously Lurch has long ago abandoned that idea(to be taken seriously) when it comes to himself!

All that's needed are at least one more Supreme Court vacancy before Bush leaves office.

It's not going to happen unless one leaves feet first.
