Actually, it takes 60 to prevent a filibuster, hence 41 are needed to creat one. Possibly 42 since the VP could make the 60th if needed I assume.
Your point is well made though .. he's still about 30+ short.
It takes 40 to filibuster, 60 to break it.
I'm sure he assumed that the vast number of people who would be reading his email would not be able to comprehend a number so large as "60". So he wrote "more that two or three" so it was in a form that they would understand even without having to look down at their bare feet.
