Officer convicted in Iraqi's death sorry

FORT CARSON, Colo. (AP) - Fighting back tears, an Army interrogator convicted of killing an Iraqi general by stuffing him headfirst into a sleeping bag and sitting on his chest apologized Monday and asked the military jury not to separate him from his wife and children by sending him to prison.

"I deeply apologize if my actions tarnished the soldiers serving in Iraq," Chief Warrant Officer Lewis Welshofer Jr. said at his sentencing hearing.

Welshofer, 43, was convicted Saturday of negligent homicide and negligent dereliction of duty. Prosecutors said he put a sleeping bag over the head of Iraqi Maj. Gen. Abed Hamed Mowhoush, sat on his chest and used his hand to cover the general's mouth while questioning him at a detention camp in Iraq in 2003.

Prosecutors said the general suffocated.

The jury of six Army officers was to begin deliberating the sentence later Monday. Welshofer faced up to three years and three months in prison, a dishonorable discharge and loss of his pension.

The judge, Col. Mark Toole, said Monday a juror had sent him a note asking if part of the verdict could be reconsidered.

Toole gave no details but said it was too late for such a request. He said the note would be sealed and would be available if the case is appealed.

And this was not the first time something like this was tried, so who didn't straighten him out the first time?

Why do you suggest that his actions were as a result of his training? The officer may have acted of his own volition contrary to military protocol.

Surely a CWO was not in charge This mans superior needs to be facing the music as well as him. The real scandal here is that the officers have escaped unshaded through all the different mistreatment of detainees. If the line officers don't know what the hell is going on under their command than they need to be relieved

Seriously.
Does not a CWO outrank a CMSGT?
I was USAF, and we did not have them, so I am unsure.
But I can tell you the nominal OIC has minimal actual authority, much less real operational control, over a high ranking and/or experienced NCO.

perhaps in the AF,
In the Marines and Army(as far as i know)
WO's are mostly for helicopter pilots and technical jobs
I would like to find out what this guys MOS was that he was a CWO and doing a hands on interrogation, that alone is weird.

Well that's just plain funny, I don't care who you are!
LOL!

But back to the topic...
Even though I was the NCOIC of Combat Intelligence Operations, I was forbidden from conducting advanced interrogation techniques with any hapless combatant,legal or not, who might have come to be under my direct...attention.
Anyone with a working knowledge of the UCMJ knows which articles can be given a cursory pencil whipping, and those which if ignored, will cost you your career, and quite possibly your future freedom.
Such things are difficult to explain to civilians, let alone combat troops.
But the combat troops have at least one advantage over civilians in such situations...they have been trained to understand that the ROEs are inelegantly designed to attempt to bring a semblance of order to the chaos of war, and are based upon the lessons learned of those who lived to reflect upon past wars.

Yeah, a sleeping bag upside down and sitting on the chest don't make a whole lot of sense but as the NCOIC you answered to a o-fill in the blank correct? Don't take this the wrong way but I can see in the AF COC a o-2 or o-3 not wanting to mess with a e-6 oe wo-x. But i just cant fathom why a wo would be doing an interrogation and that he would be the senior nco or officer there had to be someone higher that knew what was going on and he/she should have put a stop to it not to protect some s@$$bird terrorist but his WO

Again, I claim ignorance of the CWO's position of authority.

I do know I had occasions to officially request(politely issue a lawfull order) an O6 in my direct chain of command, to walk away while I did my "thing" all by my lone E6 self. Any abuse of that narrowly defined mission driven responsibility would have subjected me to the most severe punishment allowed by the UCMJ.
The "buck" would have stopped with me.
