TRAGIC CHILD TOLD ME HER SAD SECRET: 'I WISH THEY WERE DEAD' (7 Year old Nixzmary Brown)

A week before she died a violent death at the hands of her sadistic stepfather, a battered and forlorn Nixzmary Brown confided, "I wish my mommy and daddy were dead."

Perry Robinson will never forget those words — or any of the other unsettling encounters he had with the solitary, sad-faced 7-year-old in the park across from her family's apartment in the Bedford-Stuyvesant section of Brooklyn.

The retired paralegal used to see Nixzmary in Tompkins Park while he played with his nieces and nephews — and he "was not surprised" when her lifeless, battered body was found naked on the floor of the apartment early this week.

He had seen the bruises on her painfully thin arms and legs, he had heard her stepfather order her to "get your f- - -ing ass over here," and he knew she was living in fear.

But still Robinson, 49, was shocked at police accounts of the torture the little girl had been subjected to — at charges that her stepfather, Cesar Rodriguez, regularly tied her to a chair, beat her with his hands and a belt, sexually assaulted her, and forced her to eat cat food and use a kitty litter box, while her mother, Nixzaliz Santiago, did nothing to help her.

"I should have taken her to the precinct," a guilt-ridden Robinson told The Post yesterday. "I should have said, 'Come on, let's go to the precinct.' "

Robinson recalled the first time he saw Nixzmary in the park. It was last September, and he was with his nieces and nephews, who live nearby.

"She was running back and forth like a normal 7-year-old," he said. "I noticed her when her father came to the stoop and shouted at her, 'Get your f- - -ing ass over here.'

Like I said, this piece of dirt needs to be prosecuted right behind the 'dad' who killed this child.

Absolutely. How anyone could allow something like this to a child just breaks my heart. The child looks to her parents for safety. When she can't find it there she looks to strangers and she was let down by them as well.

My grandson's mom has 4 children by 4 different men. I curse the day our son fell for her. They are apart now and my son has seen the light. However, out of the clear blue, my grandson says, "I hate my mommy, I hate her alot." Makes me wonder since he is only 3.

I thought you were legally bound to contact the police when you suspect this type of abuse.
If so, this guy could be brought up on charges himself.
Anybody know anything about the legal aspects of this?

This idiot should have gone INSTANTLY to the police and called a child welfare emergency number. Some of the blood of this child is on this idiots hands.

I wish he would have called the police immediately... I suppose he didn't realize she would really be killed.

I do to, but this man isn't to blame. Child Protective Services had been contracted many, many times and did nothing. The school tried to intervene, and was squashed.

The people who are responsible are the demon pig of a husband and his sow wife.

I hope they put to death her step father (a monster if there ever was one), and as for the mother, I predict she will claim abuse herself and offer to testify in order to save her sorry behind.

Yesterday, the NY Post said the mother saw a picture of her child in the newspaper while the mother was behind bars. She cried for herself, saying she wasn't to blame.

There were no tears for her little girl, just herself.

This is a memorial to the little girl.

The loving mother with the bad hair dye job.

Here is the step father:

The poor schnuggims looks a bit frightened.

According to news reports, he came home and discovered the girl had taken yogurt out of the refrigerator without his permission. He beat the girl and locked her in her room. When he went on his computer after wards, he found someone had "messed with it." The other children immediately blamed Nixmary (she was blamed for everything in that hell house).

The step father then filled a bathtub with water, drowned her until near suffocation, and then beat her head again the faucet until it was smashed.

The little girl moaned for her mother, crying "Mommy! Mommy!" for two hours. No one came to her aid, and then she finally died.

Charges can only be brought if someone is a "mandatory reporter" under the state statute, such as a teacher or a doctor.

Regular people have no legal duty to report signs of child abuse -- regardless of whatever moral obligation.

What a shame.
I recently found out about a young girl who claimed to be abused by her stepfather. I wrote a very nice letter to the local police, explaining what I knew, along with the disclaimer that I realize that not all claims are legitimate. Told the police that I didn't want to have anyone falsly accused but that I would like it looked into.

The reporter's notes and/or tape recording are the only evidence against him. This might be admissible as "a statement against interest", which means since his his statement does not put him in a good light, it is can be accepted as true, even though it is hearsay.
On the other hand, his lawyer would probably say that he was just trying to get his name in the paper, that's why he said what he said to the reporter, and it isn't actually true. His lawyer wouldn't let him answer any further questions, citing the 5th amendment.
His lawyer might also make the claim that at the time he didn't consider the child's statement believable. Now with hindsight he regrets not doing something. Children have been known to lie and exaggerate. How many parents on Free Republic can recall their own children saying to them "I hate you," at least once in their childhood? Not believing a child is not a crime.
With no other evidence, he probably would never be prosecuted, as the only evidence that he knew anything is his own words.
If he gives the same story to the police, he will probably be in trouble.
Of course there may be some other evidence not mentioned in the story, so he might already have a problem.
I would hope that in the same situation I would not have abandoned the child to her faith. But in his defense I must say that most people don't see starkly true evil in their day to day life. Therefore when something like this conversation happens with a child, the mind draws back. "That can't be true, I must be misunderstanding the situation, that can't really be the facts of the matter. The child didn't really say what I thought she said. She couldn't have. There must be an innocent explanation for the bruises." And you talk yourself into doing nothing.
I like to believe I would have made a better decision than this person.

Perry=a huge D*ck. You always act, even if you're totally wrong, what has it cost you? It cost this little girl her life.

Quick story, walking through Newark Airport about a year ago, this urban sort of fellow, is walking down through the terminal screaming 'MF this MF that" I am gonna kick your "A**"...we all looked puzzled, this very urban fellow was in a rage. WE all then saw the target of his rage, a little 6 year old girl who was walking ahead of him, he walked up behind her and hit her in the HEAD. This was guy was easily 6-2 195 and she was all of 40lbs soaking wet. She went flying. He grabs her and picks her up and starts walking toward the exit, telling us all to mind our mf business.

We all fought the urge to kick his ass, but none of us wanted to end up in Newark City lock up with his homies, so instead we formed a posse.

About 60 other concerned citizens and myself followed his ass to the exit, where about 6 of Port Authority Cops were guarding the check in at Newark. The prick denied what he did and his girlfriend/wife/slam piece, whatever starts defending him saying that if he goes to jail, its not fair.

Guess what?? The cops cuffed him and took him in. Seems that Newark has security cameras everywhere and they caught the abuse on tape....tsk tsk tsk...

So Perry, you could have gone in the house and called the cops. When you KNOW a kids been abused (either seen it or seen the immediate evidence) you always act, you might feel dumb if you are wrong, but it sure beats feeling guilty when an innocent kid is dead.

Just FYI....my mother has kids by different fathers...she was raised in an uppermiddle class family, was married to all 3 men, has 3 great, normal, healthy kids (though sadly two have grown up to be liberals...)and was(and is) a fabulous mother

This is hardly an automatic indictment on its own

----I couldn't stop the tears for this poor little soul. My God what monsters are lurking out there are capable of is beyond comprehension. I wish that man had gotten help for her.

Agreed, but child welfare was aware this girl was being abused. I read they went to the apt. and were denied entrance. Then they just.....went away. I doubt most abusers just open the door and let you in. They've had three or four murders in families under their watch recently. They are not doing their job properly.

These "parents" deserve to be executed.
