Schumer Gets Schooled on the Constitution

Sen. Chuck Schumer (D.-N.Y.) crafted the following questions for Samuel Alito in hopes, I suppose we're to assume, trap him on the question of a "right" to abortion.

Here's the transcript:

SCHUMER: Does the Constitution protect the right to free speech?

ALITO: Certainly it does. That's in the First Amendment.

SCHUMER: So why can't you answer the question of: Does the Constitution protect the right to an abortion the same way without talking about stare decisis, without talking about cases, et cetera?

ALITO: Because answering the question of whether the Constitution provides a right to free speech is simply responding to whether there is language in the First Amendment that says that the freedom of speech and freedom of the press can't be abridged. Asking about the issue of abortion has to do with the interpretation of certain provisions of the Constitution.

SCHUMER: Well, OK. I know you're not going to answer the question...

I heard this on Rush today -- 100% embarrassing for Schumer.

And I was unsurprised when NPR didn't include the exchange in their recap of today's action.

Abortion is the one issue that holds their party together. I've asked innumerable Democrats who hold moderate to conservative positions on most issues to tell me why they vote Donkey, and 95% of them cite "abortion" as the reason. .....the other 5% usually mumble something about "the environment." Without the "pro-choice" movement the Democrat Party as we know it would cease to exist.

Schumer needs to be schooled alright but it is not on the Constitution. He needs a refresher course in 'life'.....

What a pathetic creature he is and I wonder how his constituents can support this weinie......

Is it in the Bill of Rights?

Funny how Mr. Schumer believes that abortion a right expressed in the Constitution like the First Amendment, but has so much trouble with the words in front of him when reading the Second Amendment.

I think Chuckie would get this okay:

Comprehensive health care, being necessary to the well-being of the community, the right of the people to have and perform abortions, shall not be infringed.

Tonight on Hannity and Colmes Zell Miller basically said that Ted Kennedy might want to think twice about delving in to a persons past when they were younger. LOL!

Exactly! The Democratic Party is the party of "socially progressive" activists. And this hearing makes that very clear. There's not a true public servant in a leadership position in the party.

Sorry, but try reading the Schedule of Emanations and Penumbras. It clearly states that the "right to keep and bear arms" applies only to certain special members of the National Guard when not engaged in actual combat or any of various other activities and not to the people generally. The same Schedule, kept and maintained by the Democratic National Committee in confidence but which is an integral part of the Constitution, states explicitly that abortion is the most fundamental right protected under the Constitution. Without the right to abortion, no other rights can exist, and women would be subjected to the horrors equivalent to those of the Taliban--and worse.

Because Judge Alito appears so demonstrably unfamiliar with the all-important Schedule of Emanations and Penumbras, the Democrat-dominated Senate will not confirm him to the Supreme Court.
