Rush Limbaugh played that exchange yesterday. And yes, it will go down as a "classic". Kennedy came off sounding WAY too belligerent AND stupid/ignorant of the NY Times coverage of the very information he was "threatening" to subpeona.

One senior Republican in the hearing room said of the situation: “After three full days of attacks against her husband’s character, Mrs. Alito had enough. Democrat behavior during this hearing has not only been wrong, it’s been embarrassing. Ted Kennedy is nothing but a bully.”

Ted Kennedy is nothing but a murderer.

"On July 18, 1969, at approximately 11:15 PM in Chappaquiddick, Martha's Vinyard, Massachusetts, I was driving my car on Main Street on my way to get the ferry back to Edgartown. I was unfamiliar with the road and turned right onto Dike Road, instead of bearing hard left on Main Street. After proceeding for approximately one-half mile on Dike Road I descended a hill and came upon a narrow bridge. The car went off the side of the bridge. There was one passenger with me, one Miss Mary ( Kennedy was not sure of the spelling of the dead girl's last name, and offered a rough phonetic approximation ), a former secretary of my brother Sen. Robert Kennedy. The car turned over and sank into the water and landed with the roof resting on the bottom. I attempted to open the door and the window of the car but have no recolection of how I got out of the car. I came to the surface and then repeatedly dove down to the car in an attempt to see if the passenger was still in the car. I was unsuccessful in the attempt. I was exhausted and in a state of shock. I recall walking back to where my friends were eating. There was a car parked in front of the cottage and I climbed into the back seat. I then asked for someone to bring me back to Edgartown. I remember walking around for a period of time and then going back to my hotel room. When I fully realized what had happened this morning, I immediately contacted the police."

Immediately?! That's almost laughable.

He knows enough to dive back down to get her, then naps in the backseat of a car, hitches a ride, goes for a walk, goes back to his hotel room, waits till morning, then Immediately contacts the authorities.

And good 'ole Teddy was saying to himself, "Mission accomplished, I made a woman cry. I am so proud of myself."

As you know, I sent this to my local conservative talk station, 660 AM KSKY Dallas.

Below is the original email, followed by the response.

---

Hello KSKY,

I was *extremely* disappointed in a news report I just heard on KSKY during the 6:30 PM report.

Your reporter said that the wife of Samuel Alito left the hearings today after Senator Lindsey Graham pressed the nominee with questions about whether or not he was a "closet bigot." Then the reporter quickly went on to the next report.

No context was given, and an uninformed listener would have reasonably drawn the conclusion that Lindsey Graham was responsible for causing the woman to cry.

The truth, of course, is that Ted Kennedy and Diane Feinstein had attacked Mr. Alito's character and implied that he was a bigot, yet this was not reported in any way. Lindsey Graham asked his question, and then quickly assured Mr. Alito that he knew he was not a bigot.

Fortunately I did not depend on the reporting of your station to get the truth, or I would have been left with a distorted view of reality, as many of your listeners no doubt were.

In the best case, KSKY has demonstrated very irresponsible and incompetent reporting in my opinion. In the worst case, you have shown that you have the same liberal bias that is earning the contempt of fair-minded people across America.

I do not understand why this was allowed to happen.

(My name)
Dallas, Texas

---

Dear Mr. XXXXX

Upon review of the 6:30 PM top story, I can understand your frustration and disappointment. I do sincerely appreciate your comments. We also had a shift change at that point, someone training to fill in, so we had a few challenges at that moment.

Thank you again for bringing this matter to my attention. Please continue to listen to K-SKY, and let us know what you think.

Sincerely,
Gordon Griffin

I think AP was responsible for issuing the misleading story, and a lot of news outlets just read it uncritically.

The undisputed facts of this case is that an affidavit accompanying the warrant included the request to search all occupants. The majority of judges found that technically the affidavit should have been explicitly referenced in the box where John Doe's name was inserted.

Alito's dissent was that while technically the majority opinion was accurate, the understanding of the police at the time of the search was that they were authorized to search all occupants. So unless you want to argue that it was entirely unreasonable for the officers to assume that all occupants were covered by the warrant in combination with the affidavit - even if they were technically mistaken in that assumption - then you have allow that Alito has a legitimate point of view in his dissent. He had a different theory to apply in this case.

Whether you agree with Alito or not on his legal reasoning in this case, his is not an outrageous or unreasonable dissent. Therefore, to use this case to argue that Alito is a threat to our civil liberties or is some "strip search Sammy" is intellectually dishonest and plain silly.

Thanks so much for sending the flowers. I hope they reached her!!!

The Democrats have been disgusting but most importantly, this whole circus in the "approval" of Judges has got to be changed.

All it has become is "face time" for the Senators. Someone noted that as soon as he's off camera, the Cape Cod Orca leaves the room.

So this smarmy posturing for the cameras has got to come to an end. Time to change how the Senate approves Judges. I vote for a big change in the Judiciary Committee.

I totally agree...like Rush said yesterday...this is just for fundraising.

AND, if you have POTUS candidates on the committee, like Feingold...then we know he is fishing for more than just the "fairness" of the candidate.

On Rush today...he said that Biden gave an interview with CNN after yesterday's session...and he said HE was disgusted and that the probably should do away with the hearings...and just go to a floor vote...and have the Senators all fight it out with the whole Senate...

Which sounded so "generous" considering so many judges are not even being let out for a floor vote...until, like Rush said you think about the ramifications.

If they do away with the hearings..these idiot Senators would be able to say these lies...and posit all kinds of "outcomes" if a nominee is confirmed...BUT, the nominee wouldn't be in the Senate and have a chance to rebut their lies and suppositions...

Biden just THINKS he is smart!
