I can't for the life of me understand this. Why not go to trial, win, and then counter sue the plaintiff for all costs? If this was done, then all the nonsense would stop. I know if it happens to me, I am proved not culpable, I am on my lawsuit to recoup damages and costs asap..

i don't know why people didn't do this. if mcdonalds had done this after the hot coffee incident, or gm/ford had after the first lawsuit against them, or if one of the first harassment suits had, we wouldn't have so much of this crap happening. but they get the number crunchers out who figure that they'll be out X dollars, Y man hours, Z worth of negative publicity, then if the company won and brought countersuit, they'd have to add a new X,Y, and Z. at which point the number crunchers look at the plaintiff an realise "they could NEVER pay that off." so they take those two figures and and compare it to whatever the settlement is and usually settle because its cheaper and they save themselves lots of time.
but all the figuring they originally did on the first lawsuit, they failed to consider that if one person gets away with it, 1,000s more will try. and they'll have to pay out every time.
either that or they just figured they could use it as an excuse to jack up prices and give themselves more profits.
