I sincerely think the Democrats were banking all the marbles on this loon, Dujack and his Senate testimony to "destroy" Alito. This would have led to "unusual circumstances" and therefore a reason for filibuster.
Senator Cornyn and his staff put that loon, Dujack, "out to pasture".
Saturday the fax machines began cranking out "new" talking points for the Sunday shows. Before the destruction of Dujack, I would bet all the Democrats were going to take a calm and mild position on Alito and wait on Dujack.
So much for that, now they have chosen abortion as their reason for filibuster. Back to plan A, so to speak.

Jane Harmon is using the argument du jour in her conversation with Brit Hume - that although she is a "trained lawyer" she did not object to the President's use of NSA "domestically" because she could not discuss it with anyone until the President, himself "disclosed" its existence [in response to the publication of its existence].
She said that Congress has vast resources of legal blah blah and now she "knows" [been told] what she should have objected to in all those briefings that she had at the White House.
I thought only J Rockefeller was using the "I'm too stupid" defense. I guess it is going to be the dem party line.
