The matter of the malevolent robin is no longer a federal case.
U.S. District Judge William D. Stiehl on Tuesday dismissed a Centreville woman's suit alleging that a bird attacked and seriously injured her while she was shopping at Lowe's Home Center in Fairview Heights.

I remember when this incident was first reported.
I love the lawyer's line, "This was no sparrow", upon speculation that the bird was a Robin.
I'm still laughing.
BTW, a moose bit my sister in this same store.

Good question. I doubt there was diversity jurisdiction because the complaint only sought 50k- has to be at least 75k to invoke diversity jurisdiction.

The story says she was seeking "more than" $50k... but then that doesn't lead me to believe that she was asking for at least $75k.
But I really can't see how federal law would be invoked in a simple negligence / personal injury case like this one. It would have to be diversity.

I'm glad you asked; I learned from the replies you received. I can sometimes catch satire, but the basis of this one has had me puzzled, too. Satire is so much more fun when one is clued in. (A lesson from having one's beeber stuned is to always use the spell check!)
Although it wouldn't have helped in this situation, I have found the
FreeRepublic Lexicon to be worthy of a bookmark.

Man the way the story read she was a light weight and the Robin must have been the size of a small truck.
Has America come to this? A woman can't defend herself from a POed Robin? 30 years ago she would have been laughed out of the hair salon for telling the story.
