Scott Thomas update: mom's guardianship continued!

Today was the long-anticipated status hearing on guardianship for Scott. 

The hearing took place in judge's chambers with Pamela and her attorneys and Eliza and her attorneys.  Pamela presented the judge with information that she has now filed with the court to have Scott declared "partially capacitated".  This means, at the very least, that he would then be allowed to indicate his preferences for his social environment, such as who is allowed to visit.  He has repeatedly indicated that he does not want to see Eliza, but he does wants to see his son.  

Pamela also informed the judge that, after Scott is legally determined to be "partially capacitated",  they would be filing for a divorce for him.  [emphasis mine]

  Eliza indicated to the judge that she would fight any divorce proceedings. 

The final item that Pamela presented to the judge is that Scott is scheduled for surgery to close his tracheotomy opening, which should allow him to regain his ability to speak and make sound. 

Based on all the above information, Judge Wilkes ruled to grant Pamela another six months of full guardianship of Scott.  This will be a crucial time for Pamela and Scott, as they continue to work, not only for Scott's recovery, but for him to regain the right and ability to truly "speak for himself".

At the very least, why don't they see if the child can breathe on her own without the respirator.

Why do they have to remove the respirator and feeding tube simultaneously?

What has this country become?

Doctors have been wrong countless times.

Yes, the bizarro world is here at last. Some people think states should have unlimited power, others think the Feds should, some say judges should, others say Congress or the Prez should. Every time, they say "the laws be damned, these are extenuating circumstances that require unlimited extralegal power". No matter who has unlimited power, unlimited power means only one thing - tyranny.

There are days I feel like we're living in Pottsylvania. (Old fans of Bullwinkle will know exactly what I mean...)

You'll notice that quite a few of the people on that other thread who are cheering for this ruling, are the same people who always cheer for death. Some of them are cheering because they support unlimited State rights. They're so angry about the cases of States' rights being dimished, that they no longer believe in the separation of powers. They think all rights should belong to the States, the Federal government's only function is to support State rights, The Executive Branch's only function is to conduct wars and keep its nose out of the rest of the Nation's business, the Legislature's only functions are to make declarations in favor of State rights and divert funding from the People to the States, the Judiciary's only function is to rule in favor of unlimited State rights, and the People's only function is to comply. Does that cut through the fog, and help you understand where those irrational comments are coming from?

She has been sentenced to death. Now if she were on death row and suffering a heart attack while being strapped to the gurney, she would be treated and brought back to health first. Sanctity of life and all that. On the other hand not a hint of mercy for her, not a drop of water for Terri.

For, in a court of law, they have been found guilty of innocence.

She's worth a lot to them dead, for organ harvest. But if she is allowed to live, she's a heavy cost. The "moral" of the story from the right-to-die viewpoint is: We should beat our children to death with baseball bats. It's so cost effective!

WND's spike list is an EXCELLENT idea -- except for calling it a "spike" list. A lot of folks won't understand that. They should give it a title that's a little more down to earth. For instance, "The 10 most important stories that the liberal press suppressed." Or, "The 10 biggest media coverups of 2005." (Hey, Joseph Farah, a helpful suggestion, isn't it?)

I think they goofed also in putting in the Cisneros cover-up because it wasn't really a 2005 story. That's breaking news right now. It is a cruncher of a story, though, and I can understand not waiting until the 2006 List to give it an award :-)

All in all, this is a terrific feature by WND.

My understanding -- open to correction from any passing medic -- is that in true brain death, the whole body shuts down in a few days. I.e., you can't keep such a patient alive even on a ventilator.

"Brain death," as defined by the famed Harvard committee back in the late 1960s, is another matter. It was specifically designed to declare the patient "dead" in time to harvest his organs.

By the older definition of death, all bodily function ceased. Everybody understood that. Now we start carving them up like cadavers while their hearts are still beating. After surgery, of course, they really ARE dead. But the problem is, some of them would have recovered. How many are killed by surgery rather than by prior injuries? And how does that differ from murder?

That's what I wonder about. If they declared me brain dead to cut out my gizzard, what if I were still conscious of what they are doing. Of course they wouldn't offer me an aspirin, would just start slicing.

After all, they need the parts nice and fresh and drug free.

And who would know the difference or even care?

There I am, not much value, but a fine tuned heart and in the next bed is a guy with lots of bucks and really needing a new ticker. Tell me they will do the right thing.

Follow the money. Where there is a strong dollar incentive to do the wrong thing, the wrong thing will be done.

The only defense we have against it is moral law. But thanks to a century of liberal rule, it is illegal to write laws based on morality, or teach right from wrong in schools, or to post God's word in a courtroom.

Not so long ago, not knowing the difference between right and wrong was the legal definition of criminal insanity. Now it is the central teaching of liberalism.

Most people think brain dead means dead. They don't realize that patients who laugh, cry, and attempt to talk are declared brain dead. The public reaction to Terri's murder was swayed by the many reports claiming she was brain dead, which people understood to mean she was already dead.

Good point. Many people have accepted the lies spread in the media, including such nonsense that Michael was a great husband and Terri wanted to die.
