The establishment of the FISA court did not amend the Constitution as to the Presidents responsibilty and power during time of war.

I didn't know that we were at War .... That was Bush's 1st mistake .... NOT Declaring War. This WOT sure is looking like the "War on Drugs".

The Constitution does not give the President the power to declare war. The power to declare war is given to Congress. The constitution does not put any limits on how to declare war, just that Congress is the branch of the Government to declare war.
