Police: Rape suspect was on coke binge

PLYMOUTH -- A Framingham man calmly described to police how, after a year of abusing cocaine, he kidnapped a woman and her young son in Framingham and repeatedly raped the woman in front of the boy, a Plymouth detective said in court yesterday.

Evandro Doirado, 28, who lives in Framingham but is suspected of being an illegal immigrant from Brazil, admitted kidnapping the woman from the Framingham Wal-Mart on Dec. 17 and raping her repeatedly until he was arrested a week ago Monday night in Plymouth, Detective Christopher Butler said in a hearing in Plymouth District Court.

Doirado also told police he had used cocaine for a year and had been on a binge before the parking lot abduction.

"He was strikingly calm" during the interrogation, said Butler. "He was kind of resigned to what was going to happen to him."

During yesterday’s dangerousness hearing, Judge Thomas Barrett ruled Doirado was a danger to the public and ordered him held without bail.

"I find there is no other way to protect the community or the victim in this case," Barrett said.

Barrett did not rule on prosecutor Shelby Smith’s motion to force Doirado to undergo a blood test to determine if he is HIV positive. She said, in her motion, Doirado was "likely" infected with the virus.

In Massachusetts, convicted rapists -- but not accused rapists -- are required to undergo such a test. Smith said there was a way around that.

"The defendant could in fact be charged with another crime, which, in fact, you could compel the blood sample," Smith said.

Doirado’s lawyer, David Nagle, argued against the test.

"There is not a scintilla of evidence to suggest my client is HIV positive," said Nagle. "There is not a speck of evidence."

Barrett asked where the evidence came from, and Smith said it was based on information from the Framingham Police. She did not know where they got the information.

Barrett said he wants to know where the information came from before he will rule on the motion to force the HIV test.

Just another case of law interpretation protectingthe criminal. Pretty pathetic of this judge especially after what this rapist did. Where is the right of the victim?

"There is not a scintilla of evidence to suggest my client is HIV positive," said Nagle. "There is not a speck of evidence."

The lack of evidence is easily remedied by a simple test. Of course, the lawyer will do what he can to block the test. (That is his job, I suppose.) But the judge should order the test anyway.

kidnapped a woman and her two-year-old child at knifepoint - raped the woman twice in the parking lot, then took them both to a local motel where he held the woman for two days, raping her repeatedly while the toddler cowered next to the bed. Doirado took the woman with him to a liquor store, where she was able to mouth the words "help me" and the name of the motel to the store clerk, who alerted police

If this is in fact the law then it must be changed. But I don't understand why they can't compel one based on the rape alone. Most rapists leave behind DNA evidence, which requires a swab to confirm. A few drops of blood is no more invasive.

You know the Clintons and their ACLU friends have really screwed up our legal system when the accused rapist has more privacy rights than the victims.

FRAMINGHAM -- The fate of a Framingham woman kidnapped at knifepoint Saturday and reportedly raped for 48 hours could have been different if Roberto Cornejos had told authorities what really happened when he was stabbed, police said yesterday.

Cornejos, 34, of Natick was stabbed in the neck Saturday. He told police he was stabbed after a group of men tried to rob him, but authorities said he was actually stabbed by Evandro Doirado during a drug deal gone bad.

But because police did not know Doirado had stabbed Cornejos, they were not looking for him.

After the stabbing, Doirado told police he thought he had killed Cornejos, and decided to live it up before going to jail. He allegedly went on a 48-hour crime spree, kidnapping a woman and her son, and raping the 25-year-old in front of the child repeatedly in Framingham, Natick and Plymouth.

It began Saturday when, police said, Doirado believed he had stabbed a man to death in a botched drug deal.

“He wanted to ‘enjoy himself’ before he went to prison. Those are his words,” said Lt. Vincent Alfano. “Before I go to jail, I want to have a good time.’ ” Doirado picked out his victim at random in a Wal-Mart parking lot, Alfano said. “He approached her and kidnapped her by force with the child in the backseat.” Doirado drove the woman around Framingham, raping her several times and forcing her to withdraw $500 from an ATM. She was raped first in the parking lot of an apartment complex in Framingham then again in the lot of a Stop & Shop in Natick. She was also raped at a McDonald’s parking lot, but police said the woman does not recall where they were. Doirado made the woman drive to Plymouth, where he checked into the Pilgrim Sands Motel, Plymouth District Attorney Timothy Cruz said.

“He basically committed unspeakable acts against her over two days,” Cruz said. “This is your worst nightmare here.”

Kidapping suspect may have HIV

Prosecutors Friday filed a motion seeking to force Doirado to submit a blood sample that can be tested for the disease.

The motion, filed by assistant district attorney Shelby Smith, states Framingham police believe Doirado will test positive for the disease because of his known drug use in their community. The motion cites concerns for the victim's health and safety, noting allegations she'd been raped repeatedly by Doirado before local police rescued her Monday night outside the Pilgrims Sands motel.

Prosecutors also said Doirado is an illegal alien from Brazil, under investigation for possible deportation by federal immigrations officials.

Doirado traveled to district court under heavy guard Friday for a slated dangerousness hearing that would have brought him face-to-face with the victim's family.

The wall of a lock-up cell separated Doirado from the family instead. The clan sat silently in the back of the courtroom as judge Thomas Brownell waived Doirado's presence in court at the request of defense attorney David Nagle Jr.

Local police officers rescued the rape victim Monday night after she was able to alert a clerk at Bradford's Liquors that she needed help. The clerk, who also works as a counselor at the South Shore Women's Center, called police.

Officers arrested Doirado minutes later in the parking lot of the waterfront motel. He faces charges of kidnapping with sexual assault, kidnapping of a child, assault and battery by a dangerous weapon (knife) and two counts each of threatening to murder and aggravated rape. Doirado also faces a charge of attempted murder in Middlesex County.

The argument against the death penalty for rape is that if the criminal thinks they are going to die if caught, anyway, they'll have incentive to kill their victim to try to cover up their crime. The thinking is they can only die once. In this case, the criminal thought he would go to jail for life (maximum punishment) for killing a man, anyway, so he went on a rape spree. That's why I think pain needs to be reintroduced as a punishment for serious crimes. A person can be given a whole lot of pain over a long period of time that can be extended with each crime and I think criminals will fear pain a lot more that life in prison with three square meals a day or a quick painless execution by lethal injection. Cruel? I don't think so.

In fact the human mind is so adaptable that inmates can actually learn to have a very happy disposition and enjoy life very much. Imaginary worlds can be as satifying as real life, or even more so.

Look at John McCain for example.
