"Unfortunately we've not declared war." So how is this any different from actually being at war? Is it any less of a war because the Congress has not formerly declared war? Was Korea a war? Was Viet Nam a war? Neither were "declared".

doesn't matter one bit. We are at war. Doesn't matter if it is declared or not.
