This is so true:"Bush is circumventing the MSM (old) media. He is taking cutting out the middle man (since he cannot get honest coverage of the war) and is taking his case directly to the American people. Their are lots of good things happening in Iraq and we ARE winning the war no matter how bad the left and the oldstream media would like you to beleive :" We discussed this attack the left and its MSM head on and with passion!!! Yes. There are other legal avenues, such as the War Powers Resolution. He did not simply send troops. Congress authorized the mission.

He has the constitutional authority.

Doesn't FISA have a provision to allow court acceptance of the action AFTER you do the wiretap? I seem to remember that from govt. class.

If that is the case, hopefully the Dems are too stupid to pick up on that or Bush would be in big trouble here.

He would really only have one defense, that we were using it for international communications.

But I do know the folks saying that the legislation prohibits wiretapping US citizens are dead wrong. There is this:

Return to section 1801, subsection (i): "United States person," which includes citizens, legal aliens, and businesses, explicitly "does not include a corporation or an association which is a foreign power."

Well sure, but does that mean that even if you are a citizen you cash in your abovementioned rights by collaborating with terrorists? Yes you do. You have then become an "Agent of a foreign power" as defined under subsection (b)(2)(C). Such agents include anyone who "knowingly engages in sabotage or international terrorism, or activities that are in preparation therefor, for or on behalf of a foreign power," and even includes those who aid and abet or knowingly conspire with those engaged in such behavior.

Wait, that includes anyone, even citizens? Yes — subsection (b)(1) is the part that applies to foreigners; (b)(2) covers everybody. And the whole point of the act is to collect "foreign intelligence information," which is defined under section 1801 subsection (e)(1)(B) as "information that relates to, and if concerning a United States person is necessary to, the ability of the United States to protect against sabotage or international terrorism by a foreign power or an agent of a foreign power."

I gave everybody "gift cards". I couldn't tear myself away from FR for anything. Without it, I think I would have gone nuts!

And to celebrate my Birthday, I was in front of the Supreme Court, rooting for Texas-Gov. Bush!

BTW, it was Dec. 16th. Beethoven's Birthday, so I have 2 ways of remembering the day that the Supremes in a 7-2 decision stopped the algore nonsense.
