Alito and partial birth abortion.

The following is an interview I did recently with Richard Collier for our radio show “The American View.” Mr. Collier is president of the Legal Center for the Defense of Life in New Jersey. He was also a lawyer in the 2000 case on late-term abortions – John Lofton, Editor, TheAmericanView.com.

JL: Mr. Richard Collier is on the line, he’s a lawyer in New Jersey. We’re going to talk about exactly why we’re talking to him today, but first I want to praise you for not rolling over and playing dead and for not becoming a Republican Party “cheerleader” for any kind of nominee that George Bush sends forth. We on this program believe that the abortion issue is the number one premier, moral issue in our nation because it is literally a life and death issue. Our position is that pro-life is pro- life, it’s pro-all-of- life, not pro-some of life.

Your title says, "Alito and partial birth abortion."

And the exerpt you post does not even Alito's name, let alone his positions on Partial Birth Abortion.

How about posting the *relevant* part of the article instead of the first few lines?

The difference between pro-life advocacy groups and Judge on the Third Circuit is the latter is bound by the laws of the United States of America. Only an activist judge would make a ruling against the law at that level.

I'm not sure what you mean. Alito's being criticized here for striking down legislation, not for upholding it. And if you're talking about the Constitution, no one was advocating that he go against it.

As a circuit judge he is bound by Supreme Court decisions, even the $hitty ones.

There's nothing that says that he is. Of course, if he goes against SCOTUS, he'll most likely get overturned, but then it'd be SCOTUS that would be derelict in its duty, not the circuit judge.
