Ronnie Earle Now Subpoenas TV Spot Critics

Travis County District Attorney Ronnie Earle has subpoenaed two officials at the Free Enterprise Fund (http://www.freeenterprisefund.org) in connection with ads the conservative group has run criticizing him for his indictment of former House Majority Leader Tom DeLay (R.-Tex.). The ads attacked Earle, who has a history of indicting his political enemies in both parties, comparing him to an attack dog.

( The TV spot was entitled "Bad Ronnie, Bad" (Attack Dog) that is being run in Austin, and other markets. FEF started airing the TV spot on October 12, 2005. Here's the video if you missed it - Funny. It was previous posted at FR and in "The DeLay Chronicles" - TAB)

The draft subpoena served to the organization demands that Free Enterprise Fund (FEF) Communications Director Todd Schorle and executive director O'Brien Murray testify in Texas at DeLay's change of venue hearing on Dec. 27, 2005 the Tuesday after Christmas.

In the subpoena, Earle also demands "any and all documentation regarding the advertisements that have been produced or paid for by the Free Enterprise Fund, including any and all information regarding media buys by the Free Enterprise Fund for those advertisements that have run in Austin, Texas, and that may affect whether Thomas Dale DeLay may receive a fair trial in Travis County, Texas."

FEF fears that Earle is trying to get its donor list with this document request, a spokesman said. Former U.S. Solicitor General Ted Olson, now an attorney in private practice, will represent FEF in the matter. (Great FEF has Ted Olson to take on Earle the Squirrel - TAB)

FEF will be running its ads against Earle in Houston this weekend on the Sunday talk shows, including "Meet the Press."

There is no doubt he will try to subpoena donor records.

Take a trip down memory lane. When Roberta Achtenberg (Commie Lesbian Activist) was an assistant secretary of HUD, some citizens groups in California protested her plans for low income housing in their neighbirhood. She went after them big time just the same way, trying to subpoena their financial statements, membership records, etc.

Fortunately a very smart lawyer told her to go crunch some carpet.

Apparently the FEF is headquartered in Washington DC. Assuming that the persons receiving subpoenas are also in DC, do they have to honor those subpoenas?

This can get fun. Now that DeLay is indicted he can take discovery. DeLay must have a long list of media outlets and other opponents that he can subpeona for similar information.

FlAttorney's Comments: Earle is trying to make the case that a DeLay operative, i.e. Free Enterprise Fund, ran this TV spot in the Austin market in order to purposely taint the potential jury pool, as part of a DeLay tactic re his Motion for Change of Venue (out of Travis County).

On the subject, it is very obvious that Earle is a desperate and extremely unethical puppet of the Dems-Soros~Shadow Party Mob, with Earle continuing to issue a flurry of groundless subpoenas, some based on nothing more than a Dems-SSP slant article by the Associated Press or San Francisco Chronicle. - fla

Garsh! Might have to move the trial from Left-Wing Austin to a place that's more representative of the rest of Texas.

Citizens have long commented on community matters via letters to the editor. But beware of overzealous, out-of-control government employees.

To wit, "citizens had written letters to their local newspaper protesting the prosecutor’s actions. [The employee of the DA office] actually sent Amador DA investigators to the citizens homes to notify them that they were to appear before the grand jury. The grand jury transcript shows in gory detail how this proceeds to intimidate the letter writers. [The employee of the DA office] victims admit that they would be afraid to use their first amendment rights again."

The letter writers had no connection to the particular case. They were just commenting, wondering, asking. . . .

(And that was only about 0.001 percent of the total horror story.)

Ronnie's phone number is in the TV ad.

I called it. A young lady answered "District Attorney's office."

I told her, "Tell Ronnie I called and said it's not a crime to be a conservative." She then gave a little laugh, to which I said, "Tell Ronnie to just keep digging that hole."

I offered my name but she declined to take it.
