Smoking foes try to stop parents from lighting up
THE WASHINGTON TIMES ^ | December 16, 2005 | Tarron Lively

Anti-smoking activists who are driving cigarettes from public places across the country are now targeting private homes -- especially those with children.

Their efforts so far have contributed to regulations in three states -- Maine, Oklahoma and Vermont -- forbidding foster parents from smoking around children. Parental smoking also has become a critical point in some child-custody cases, including ones in Virginia and Maryland.

In a highly publicized Virginia case, a judge barred Caroline County resident Tamara Silvius from smoking around her children as a condition for child visitation. Mrs. Silvius, a waitress at a truck stop in Doswell, Va., calls herself "highly disappointed" with the court's ruling.

"I'm an adult. Who is anybody to tell me I can't smoke or drink?" she said in an interview yesterday.

An appeals court upheld the ruling, but not before one judge raised questions about the extent to which a court should become involved in parental rights and whether certain behavior is harmful or simply not in a child's best interest. Mrs. Silvius says she complied with the decision by altering her smoking habits.

"My children know not to come around when I'm on the front porch with my morning coffee, tending to my cows or out in my garden, because I'm having a cigarette," she said. Still, she thinks this was not a matter for the courts because it was not proven that she posed a risk to her children's health.

Either way it's a piece of elitist trash masquerading as a conservative.

Sadly, there seem to quite a few of those on FR.

But at least this one finally left the fray. :-)

It seems to me there is probably a much greater correllation between alcohol use and child abuse, or pornography and child abuse, or recreational drug use and child abuse than cigarettes. Being a smoker is not prima facie evidence of abuse, regardless of whst the gnatzis say. How many asthmatic kids are from smoking vs nonsmoking households?

One more thought. How many of these antitobacco jihadis "For the children!!!" are pro-abortion?

I can't wait to read the celebratory posts regarding this issue. If we think that government nannyism is good in this case, what other cases is it good for? Especially if it is for the children and in the name of health.

See this article as an example of where this is headed: http://www.freerepublic.com/focus/f-news/1541523/posts

"If like minded adults want to smoke then let em hang out in places where they can do their thing."

Except that has been banned by the like minded nanny staters, such as you. Just like when smoking areas were banned in the work place, then the gnatzies complain that the smokers are smoking around building entrances.

It's enough to sicken any freedom lover. I guess it doesn't sicken you.

"Common sense says that anything that you put into the air that has carginogens and other harmful chemicals that kids are going to inhale is probably something you shouldn't be doing at least not around them."

I suppose you wouldn't want people using toxic substances to clean their homes either. Or to cook food. Or to burn candles in the event of a power outage. Or to warm up a car in the garage.

Both her and her brother were born underweight.

Ayup. Mom smoked and I only weighed 5# 9oz. when I popped the hatch. Now I am 6 ft. 1 inch, weigh 235 (I could lose another 10#, but not much more before I start cutting the muscle mass.)

Mom fed me well. None of that preservative laced convenience food. Hmmmmm. Wonder how we ever got by without eating all those chemicals?

"I hate smoke and I would like to see it banned in all public places."

It already is. All Federally or state owned buildings have banned smoking. Unless, of course you think someone besides a private citizen owns all other properties. If that is the case, then you might as well admit to adoring socialism, just as long as you get to be the fascist in charge.

"Smoking does greatly increase the likelihood of lung cancer."

Really? Then riddle me this, dogman, why does the highest per capita smoking population in the world have the lowest per capita heart and lung disease incidence in the world?

" But don't make yourself look foolish by claiming your anecdote trumps science."

Post the actual science. Good luck.

You're right. If you own private property next to a school for example, who is the government to say you can't have a bar, or strip club or sell porn from there or next door to your house even?

Who is the government to say you have to have adequate, marked, unblocked exits that swing out in your privately owned business where the public is invited?

Who is the government to say you have to have adequate wiring for designated loads in your private business?

Who is the government to say you have to maintain health standards where food is prepared in your privately owned restaurant?

Who is the government to say you have to use 2x6's when 2x4's would be cheaper for building a home or privately owned rental units?

Who is the government to require handrails on stairs?

"Post the actual science", the answer might be there.

Heck, my mom caught ME eating DIRT one day.

Funny thing about that. So many people did at one time or another, that someone did an honest (non-agenda driven) study and found out that people who ate dirt generally were doing so to pick up nutrients missing in their diet. They found out it was beneficial.

Would that happen with tobacco? My Powerball ticket has a better chance of paying off.

However, what I do in my own home is my business.

This is, ultimately, the crux of the issue. All the Hillary wannabees around here want to be the collective village that raises your children and decides what you can and cannot do, and still try to fancy themselves conservatives.

That dog just won't hunt.

You'd get better results keeping the kids away from the NY Times (second hand terrorism).

Have you ever considered veterans have been exposed, in general, to a heck of a lot more toxic things than a cigarette? Has anyone studied that?

You have no constitutional right to spew carbon monoxide smoke anywhere around me without my consent...anywhere.

You had better go after the auto makers if you are worried about Carbon Monoxide. If you drive just an average amount, you have every smoker on this thread beat in CO emissions in spades--and I bet you haul your kids around in the source.
