Well, for past offenses, any prior act would be "ex-post facto". Under the constitution, no new prosecution can ever be made under a law not in effect at the time of the act.

WASHINGTON -- After months of resistance, the White House has agreed to accept Sen. John McCain's call for a law specifically banning cruel, inhuman and degrading treatment of foreign suspects in the war on terror, several congressional officials said Thursday.
The congressional officials spoke on condition of anonymity, saying they did not want to pre-empt an expected announcement later in the day at the White House, possibly by President Bush and McCain.

The "NAY" votes are just about a complete list of Senators who would match the FR definition of "conservative". So the next time you hear talk of a Republican Senate majority, remember that the "conservative majority" is nine votes. ;)

It's really not a bad thing that the US goes on record saying that we don't accept torture as a policy. We are already on record that we don't accept torture. Read the damn thing ... would prohibit "cruel, inhuman, or degrading treatment or punishment"
