Florida Judge Upholds Rush Limbaugh's Doctor-Patient Confidentiality

MIAMI, Dec 12, 2005 /PRNewswire via COMTEX/ -- Roy Black, Rush Limbaugh's attorney, issued the following statement regarding Judge David F. Crow's decision today prohibiting prosecutors from asking the talk show host's doctors about his medical treatment and condition or information he shared with his doctors during his care and treatment.

Judge Crow's ruling upholds our argument that the State cannot breach doctor-patient confidentiality just because it has obtained some medical records, and thus the state cannot ask the doctors its questions posed to the court during the hearing.

Judge Crow's decision prohibits the State from questioning Mr. Limbaugh's physicians about "the medical condition of the patient and any information disclosed to the healthcare practitioner by the patient in the course of the care and treatment of the patient."

We are pleased with the court's ruling upholding the patient's statutory right of doctor-patient confidentiality. We've said from the start that there was no doctor shopping but Mr. Limbaugh should not have to give up his right to doctor-patient confidentiality to prove his innocence.

The medical records that the State has seized and reviewed now for nearly six months show that Mr. Limbaugh received legitimate medical treatment for legitimate medical reasons. Mr. Limbaugh has not been charged with a crime and he should not be charged.

The fact that you would even vaguely equate O'Reilly and Limbaugh as conservatives shows that you either have no honesty or have no clue.

Oh I think it's the latter option. The Republican is probably honest enough, he or she just doesn't have a clue.

If Rush is guilty of drug dealing, the PB county prosecutor's office must be the mother lode of prosecutoral incompetence since it hasn't shown a lick of credible evidence of his "crime" after 2 years of intensive investigation of everything they can lay their hands on pertaining to Rush and his admitted drug dependency.

Addendum to # 143:

No, I don't consider a retracted accusation by a self-confessed drug peddling maid as credible evidence. I guess you could say the maid took a page out of Kerry's book and voted for Rush's conviction before she voted against it.

With the move toward patient confidentiality, Rush's case was a glaring anomoly in today's medical environment.

- Prosecutors can subpoena Rush Limbaugh's doctors as part of an investigation into whether the conservative radio commentator illegally bought painkillers, a judge ruled Monday.


Judge David F. Crow ruled that Florida laws do not prevent doctors from talking with prosecutors if the discussion is relevant to the prosecution of a crime.

The decision gave prosecutors permission to subpoena doctors and their staff, but it also protected confidential material in Limbaugh's medical records. The judge noted that Florida law prohibits the discussion of a patient's medical condition and information disclosed by a patient during treatment.

Prosecutors and an attorney for Limbaugh both said they benefited from the ruling.

"The court allowed us to proceed, within the constraints of present law," said Mike Edmondson, a spokesman for the state attorney in Palm Beach County.

Roy Black, Rush Limbaugh's attorney, said in a statement that the decision upheld "our argument that the state cannot breach doctor-patient confidentiality just because it has obtained some medical records," Black said.

Then, you were listening to somebody else. I've been listening to Rush for 13 years and he has never expressed such a thought. Drugs and the WOD have never been an issue for him.

Not really, florida's constitutional privacy amendment was created with medical privacy in mind specifically.

It was passed in the 80's when the democrats were in full panic that R. Reagan would reverse Roe vs Wade and send abortion back to the states.

Then you can't hear. It is a well known fact (even among freepers) that he said that.

Rush is a liar and a hypocrite. Call em like I see him. I don't care how conservative he is. There is no excuse for the kind of damage someone like that does to the media and conservatives.

He still can't face up to his issues.

By the way there is no difference in him buying those drugs from the street dealers and others than someone else buying weed or whatever other drug.

I know some here will make excuses for him. Hard to get over who he used to be...I know.

Given he's the number one host by wide margin and THE most influential conservative voice since Reagan, by will of the majority of the conservative movement and its substantial number of members therein, your opinion of Rush would seem to have been rejected by popular margin.

Thank God.

I'm thrilled for Rush, thrilled another attempt to criminalize conservatism via the courts is going down in flames, and rejoice when people like yourself and Liberals react in rage to these developments.

The 'Maid' had a long history of being involved in the drug trade, she got off so the prosecutor could go after the addict. Every other time they go after the dealers.
