WASHINGTON -- The Democratic senators representing the nine Western states that make up the 9th U.S. Circuit Court of Appeals signed a letter Thursday opposing a House GOP plan to break the circuit in two.
The letter was sent to GOP Sen. Judd Gregg of New Hampshire, chairman of the Senate Budget Committee, who will have a lead role in finalizing a budget-cutting bill that House Republicans hope will include a provision splitting the 9th Circuit. The bill is expected to come to a vote next week.
"The Senate Judiciary Committee is working diligently to address the questions regarding the functioning of the 9th Circuit. ... We believe that it is essential that the Judiciary Committee be allowed to fulfill its duty," said the letter released by Sen. Dianne Feinstein, D-Calif., a Judiciary Committee member.
Proponents of the split including the Bush administration argue that the circuit, which covers about 54 million people, is too big to be effective.

Actually, I'm against splitting them up. Here's why. It is without a doubt one of the greatest threats to the lives and liberty of all Americans (behind terrorism, ahead of violent crime) and there is no split that will leave you with anything but two liberal courts (hence TWO threats). And so long as the dockett of the 9th remains crowded, it will move slower and hopefully hurt us less. Split the court, split the case load and all of the sudden, both courts will be churning out pecedent setting, liberal power grabbing decisions fast than the 9th would alone.
If they "split" the 9th, does that automatically mean a new group of Judges on the new circuit? Or are they going to simply assign some of the current Judges to the new District?
The first seems most likely (adding new Judges) otherwise case load remains the same. If so, then that explains why they are opposed to it. The Dems will be damned if they will let a Republican President appoint a new line up.
In that case, I vote for post #2.

This is a necessary remedy, and conservatives need to make it a higher priority.

Perhaps but I look at it another way. We get to nominate a whole new line up of judges whether they split the current judges or create a new panel. The benefit there is a host of newly appointed conservative judges. With attrition and a few additional appointees from the next conservative President and we could have two reasonable courts. It's a shot and we don't have a prayer otherwise.
This is news? Of course the 'RATS oppose it. The 9th Circus is one of the 'RATS greatest weapons in their war on America.

I'm not for sure but I think it's closer to 90%. They are a bunch of Left coast hippies who are always telling us we can't cut down trees in our forests in Arizona. Arizonans are pretty tired of these Leftist bozos.
It's pretty simple. The 9th is entirely too big and it can not possibly serve the people of the region properly. It needs to be split up.
