Duncan says state obliged to provide services to illegals (MD)

Enforcing immigration laws is the federal government's job, gubernatorial candidate Douglas M. Duncan said yesterday, adding that the state is "legally required" to provide basic services such as education and health care to illegal aliens. "It's up to the White House and Congress to protect our borders," said the Montgomery County executive. "We want them to enforce the immigration laws and the employment laws of this country. We're waiting for them to do that. They need to do that." Mr. Duncan's remarks came after a noon rally on the steps of the County Council chambers in Rockville to announce that about three dozen federal, state and local officials had pledged their support to Mr. Duncan's gubernatorial campaign. Mr. Duncan faces Baltimore Mayor Martin O'Malley in the Democratic primary next year. The winner will face incumbent Gov. Robert L. Ehrlich Jr., a Republican. When asked whether a Duncan administration would consider cuts to basic state services for illegal aliens, Mr. Duncan said it would not be an option. "We're legally required to provide health care. We're legally required to provide an education," he said. "There are obligations and expenses we have that the federal government is not helping us with. So they need to do their job. They need to get their act together and enforce the laws of this country."

Sorry Mr. Duncan, but giving 'aid and comfort' to invaders is not 'legally required' of the state.

Matter of fact, it's just the opposite. It's illegal!

Hopefully Mr Ehrlich will come up with a better plan like just say NO!

Whether or not he is right about it being legally required or that any kind of obligation exists, there are some practical reasons that we should provide some level of care to illegals.
  1. 1) Infectious diseases need to be treated to get them out of the population. It is counter productive to not treat an illegal and then have a string of legal citizens you must treat as a result. And if you refuse treatment, then the illegals won't seek treatment, but will remain among the population.
  2. 2) I don't want a clerk trying to determine whether I'm a legal citizen or not, before a doctor sees and treats me.

So the solution is to reduce the illegal immigrants by enforcing the borders and the workplaces, not refuse care to them.

It's a violation of USC 1324 sec 8. And any violator can be sued by private citizens under the expanded RICO statutes.

Why do so many states find immigration laws to be the only federal laws that the federal government has the sole responsibility to enforce?

Let a state try to shuffle off the enforcement of federal drug laws onto only the federal government and see how quick they are smacked down.

------Legally required to foot the bill for people here illegally? What are we doing? Importing people to sponge off of us? The taxpayers are already taking care of enough people, who I am ashamed to say ARE Americans. Lazy ones. Jeez, when will it end? Yeah. I know . NEVER.

I believe federal courts have ruled that education and health care must be provided to illegal immigrants.If a case has made it to the Supremes is something I am unsure of.
If you go to an ER at any hospital you will see signs posted that state the hospital must provide services to anyone without regard to their ability to pay.

Actually, they must stabilize a patient but they are not required to provide any and all services. I know, my wife is an LCSW in case management for an HCA hospital here in Denver. They turn away all patients who cannot pay and are not in a life threatening state.
