San Francisco -- Gov. Arnold Schwarzenegger said Friday that he would consider granting clemency to Crips co-founder and convicted murderer Stanley Tookie Williams.
After a private hearing with Williams' lawyers at his Sacramento office, Schwarzenegger said he would meet again on Dec. 8 with the lawyers, Los Angeles County prosecutors and others involved.
As governor, he has the authority to commute a death sentence to life without parole. He is not legally obligated to hold a public or private hearing. Schwarzenegger decides clemency requests on a "case-by-case basis," . . .

You might be thinking of Article 4, Section 3. "New States may be admitted by the Congress into this Union; but no new States shall be formed or erected within the Jurisdiction of any other State; nor any State be formed by the Junction of two or more States, or parts of States, without the Consent of the Legislatures of the States concerned as well as of the Congress."...]
True there is no clause for forced revocation of membership, but you can always draft a new constitutional amemdment. And it can say just about anything you want so long as you don't violate the Bill of Rights.
So I'm saying draft an Amemdment to expell Komifornia, get it through congress, get it passed by the rest of the states ... then make a declaration of war against the new "country" of California, invade it, expell all the commies and "illegals" and then regrant statehood to it "Open under new Management".
I think an inmate actually tried that avenue of argument (to get out of the death penalty). Didn't get very far with the SCOTUS.

Schwarzenegger, in dealing with the two previous clemency requests, denied a hearing last year for Kevin Cooper, whose execution was later stayed by a federal appeals court, and held a public hearing this year for Donald Beardslee but declined to spare him.
So of two prior cases, one got a hearing but BOTH were put to death. So when Tookie is not spared, as he should not be, will you change your tune about Arnold or start again with January's expected execution?
I'll agree with you there. If he commutes Tookie's sentence he's signed his own political death warrant for Republicans. At least the ones who supported him in his reform agenda, not the ones who stayed home or voted against him for ideological spite.
Arnold is just listening to sound legal counsel, considering which federal court Circuit the state is within. The Ninth Circus has made noises suggesting that failure to "consider" such things as clemency and parole may result in judicial intervention. So he must go through the process of "considering."
Given that Arnold is running for re-election, there's no way that even "liberal Arnold" would commute the sentence.
Tookie is going to fry, leaving the world no poorer.
No, I won't. Because I know that Schwarzenkennedy will cave in to this monster. Bank on it!
Tookie's case is different as it is backed by the liberal Hollywood establishment that SchwarzenKennedy himself once worked in.
If he does this, he can kiss a second term goodbye.

This guys life is in Schwarzenegger's hands. He has to review the case, and probably already has. I am quite familiar with the case. The man is guilty. Everything else about his being redeemed and rehabilitated is just smoke being pumped into the air to fog over the facts of the case. What's ironic, is the same people that are demanding he be spared the death penalty, are the same ones that would scream the loudest in protest if Stanley Williams was a white man and was spared the death penalty.
Most of his supporters are criminal terrorist and racist.
As a temperature indicates an underlying infection so the "debate," "discussion," "the expression of different points of view," over this criminal indicates an underlying sickness among our population. This society cannot excrete.
Yep, and in a few weeks, he'll have cover. By doing this, he changes the media focus from the anti-death penalty advocates to the ones who will actually mention what Tookie did. When the truth gets out, the whole state of California will be demanding his execution.

I didn't vote for Arnold initially, but I truly supported his reform agenda. The unions of this state are running things and it needs to be stopped.
Fortunately, the unions didn't win in San Diego. Their candidate only got 46% - or the union vote. I'm so grateful their candidate did not win .. San Diego would have been destroyed.
