A face-saving measure by Mr. Fitzgerald. The case against Libby is absurd. He was commissioned to investigate whether there was a leak of classified information in the outing of the Plame dame. There wasn't. That should have been the end of his investigation.

Special prosecutor Patrick Fitzgerald said in court filings that the ongoing CIA leak investigation will involve proceedings before a new grand jury, a possible sign he could seek new charges in the case....For two years he has been investigating the leak of covert CIA operative Valerie Plame's identity.
To investigate WHAT crime?
It has become clear that Valerie Plame was not a covert CIA operative, and that her identity had already been "leaked" by both herself and her husband. What is the putative crime that the investigation is supposed to investigate??

While I like the popcorn; what a cushy job, no one really has to do anything except say they are investigating, probably have pretty cool offices, nice lunches, per diem, a nice hotel in Washington, fly home for the weekend. And the best he has is at worst a guy lied about telling the truth, most likely the guy forgot a short conversation from 2-3 years ago and when he tried to clarify it, got nailed for lying.

A decade from now, when this investigation over a non-crime is wrapping up, and the multi-million dollar budget is being tallied, we'll have all forgotten what it was all about.
The only reason I don't oppose the "independent prosecutor" concept is because most of the time, they are directed at agents and operative of FedGov, and time spent harassing their own is time they won't be spending harassing the rest of us.
From my reading of the law, this entire investigation should have taken at max two weeks.
