You are right. A strange comment. I have not seen any sane or insane people compare Alito to Miers.

And, to the point made in the headline, of course abortion is not a right. Sure, it is a SCOTUS precedent for whatever it is worth.

How true, how true! Alito himself admitted to great mental extertion in penning his disent in Casey because he did not understand O'Connor's "undue burden" criteria - so distinct from the more traditional "liberty interest" vs. "fundamental right" bifurcation.

There are some that are so bitter over the Miers affair that they are willing to do anything to undermine this nominee out of some twisted sense of revenge.

In Casey O'Connor gave conservatives a bone. Then she snatched it away. The woman is a great gal, but an embarrassment as a jurist. Ginsberg is a lot easier to stomach. At least you know where she stands.

An appellate judge is not supposed to behave like a supreme court justice. The CJ of a state court can claim some historical right to do so, but not a judge on an INFERIOR federal court! The people on the 9th Circuit do it all the time.
