If the woman is mentally disabled, then how did she make the decision to sue? No, her mother simply didn't want to have to take care of a "defective" child, and wishes that her child never existed.

Lawyers said that if her mother, Olga Harriton, had known of the extent of the disabilities, she would have had an abortion. I doubt very much that she would have "known" the extent of the disabilites while she was still pregnant. All the doctor could have done, if in fact he knew the mother had rubella, is advise her on the POSSIBILITY of it deform her yet unborn child. There is no absolute certainty that any disability would have been the case.
The question is, would the mother have aborted her child without any certainty at all that the child was harmed? You cannot use the knowledge you have today to make the decision then. Case dismissed for defendent.

If this woman is sooooo unhappy for being born, but is capable of suing, then she's capable of committing suicide - problem solved.
