The Duc d'Orleans is not a pretender, but the legitimate heir to the throne of France. And were such throne to still exist, he would be King. But it doesn't, so he's not, although he does have his partisans, and there is a (small) Royalist Party. (In truth, it is a social club for aristos of a certain age.)

Yes, the lex solis applies in France as well as the lex sanguinis, so whether one is born in France or born of French parents, one is a French citizen.
Citizenship can be removed, however, and lex solis citizenship of illegals is more tenuous than it would be for a clear native-born French.
There is tremendous discretionary power in French government, and appeals are taken to a separate judicial system from the regular civil courts.

A country without a constitution to guide it, can pretty much do what ever the leader wants to do. There are many countries around the world that export their troublemaking citizens to another country.
I don't see this happening, but it is more because of a lack of will on the part of the leaders of France rather then any legal restriction.
