DEMOCRATIC CHAIR CALLS ON GOVERNOR EHRLICH TO PULL ILLEGAL ADS

ANNAPOLIS—In a letter sent to Maryland State Prosecutor Robert A. Rohrbaugh, the Maryland Democratic Party urged an immediate investigation of an illegal lobbying campaign by the Maryland Republican Party.

The Maryland Republican Party has purchased at least $25,000 worth of illegal advertising lobbying the public to communicate with members of the Maryland General Assembly to influence legislative action.

According to Maryland law, the Republican Party must register as a “lobbying entity” if it spends over $2,000 for advertising and printing for the express purpose of soliciting others to communicate with an official to influence legislation before the General Assembly.

There is no record of the Maryland Republican Party being registered as a lobbying entity. Therefore, the electronic and print advertisements are flagrant violations of Maryland law.

“The Governor has an obligation to uphold the laws of the state, not abuse them. Not only are these ads grossly misleading, they also appear to be grossly illegal,” said Maryland Democratic Party chairman, Terry Lierman. “I’m calling on Governor Ehrlich to suspend this campaign and immediately pull these ads.”

“The people of Maryland will not stand for illegal advertisements,” Lierman continued. “Governor Ehrlich and the State Republican Party will be held accountable for their actions.”

RE: Maryland Republican Party’s Illegal Lobbying Campaign

Dear Mr. Rohrbaugh:

I am writing to strongly urge you to immediately investigate the lobbying campaign described herein. The Maryland Republican Party has engaged in at least $25,000 worth of illegal advertisements intended to solicit the public to communicate with members of the Maryland General Assembly to influence legislative action. [1]

On January 6, 2005, Maryland Republican Party Chairman John Kane publicly announced “Operation Sustain.” According to a GOP press release (attached), Operation Sustain is a print and electronic advertising campaign intended to impact the votes of Anne Arundel County’s three Democratic State Senators on vetoed and expected to be vetoed legislation that will be taken up by the General Assembly on Tuesday, January 11, 2005.

Maryland law clearly states that an entity shall register as a “regulated lobbyist” with the Maryland State Ethics Commission if it

“[S]pends at least $2,000 for . . . telecommunications
services, advertising [and] printing for the express purpose of soliciting others to communicate with an official to influence legislative action.” '15-701(a)(5), State Government Article, Annotated Code of Maryland.

The text of one of the three Maryland Republican Party radio advertisements entitled, “Taxed Enough – Astle” solicits Marylanders to:

“Call Senator Astle at 1-800-492-7122 and tell him to do the right thing. Tell him to vote no on new taxes.” (Attached)

Similarly, a printed ad paid for by the Maryland Republican Party entitled, “Think Maryland Families are Taxed Enough? Then Get Involved.” makes the following solicitation:

“Call State Senators John Astle, Phil Jimeno and Ed DeGrange[.] Tell them to do the right thing. VOTE NO to [former Maryland Governor Parris] Glendening era taxes. CALL THESE SENTATORS AT 1-800-492-7122.” (Attached)

According to the most current filings available, neither Republican Party Chairman John Kane nor Party Treasurer Steve Wiseman are registered as lobbyists with the Maryland State Ethics Commission. There is also no record of the Maryland Republican Party being registered as a lobbying entity. As such, these electronic and print advertisements are flagrant violations of Maryland law that deserve a complete and thorough investigation.

I thank you for your immediate attention to this matter.

Sincerely,

Terry L. Lierman, Chairman

TLL/rod

1. While the Baltimore Sun reported that “[Maryland Republican Party Chairman John] Kane would not say how much the Party is spending on the ads,” the Washington Post reported that “[t]he ads cost roughly $25,000 and were produced by MH Media of Washington.” See, GOP Ads target 3 Democratic Senators, January 7, 2005, Andrew A. Aren't there any intellectually honest Democrat voters who see this unending pattern of manipulation simply for victory's sake, lack of issue stances, lack of leadership, and lack of consistency or sincerity in their stated positions (disavowing successful blacks simply because they are disagree with the Dem talking points, turning their backs on rape victims for Clinton, etc)? How do they not run from that party in droves? How sad.

I think the thread title should note that this is "unconfirmed" so no on else comes in and gets misinformed.

I don't have a link, but I just found out (from someone who would know) that Ryan O'Doherty works for Jim Smith, the Baltimore Co. executive.

If you google him, you can even discover the size of his twice a month paychecks. Not very large.

Looks like Ryan O'Doherty has been scrubbed from the mddems.org website (Don't they know about Google?) and just after he was glowing about the upcoming 2006 election cycle:

Maryland Prepares for 2006

"This is the best system I have seen," says Ryan O'Doherty, from the Maryland Democratic Party. "We are gearing up for the 2006 elections already and aiming to get as many counties, candidates and clubs online with Orchid as we can so we can leverage the content sharing and networking capabilities of the system."

It all started with quidam who helped Clinton escape impeachment by raising the bar and getting many FReepers to jump off the deep end claiming that there were video tapes of Clinton doing coke with moronica.

Before my time but I think Jim Robinson has enough juicy red meat on FR to expose and document lots of rat skullduggery in a book. Can't wait to see him talking to C-Span's Brian Lamb on Book notes. ;o)

Now, ya'll be nice. Don't be so uncool as to send him greetings at rodoherty@mddems.org (for some reason he's no longer listed on the Md. Dem. Party staffers page, but Google remembers him well).

Ryan O'Doherty, Maryland Democratic Party spokesman, said the party does not use mandatory quotas to determine its delegation's racial composition. Instead, he said, the party has representation goals for each minority group based on the racial composition of Maryland's electorate.

Looks like the Baltimore Sun was sucked in by Joe Steffan/NCPAC:

Democrats want to hear from Steffen

Democratic lawmakers reviewing Gov. Robert L. Ehrlich Jr.'s personnel practices said yesterday that they want to hear more from Joseph F. Steffen Jr., the former Ehrlich aide who said last weekend he was instructed by top administration officials to target low-level state employees for firing.

(SNIP)

Steffen resigned in February after he was discovered to have posted derogatory messages on the Internet about the personal life of Baltimore Mayor Martin O'Malley, a Democrat who has since declared his candidacy for governor. Steffen's name comes up regularly during meetings of the committee reviewing the governor's personnel practices.

Sucks to be the Sun these days.
