As usual, the NYT attempts to find a prohibition of bad law (assuming, for the sake of argument, that the husband-notification provision was bad law) in the text of the Constitution. The Constitution leaves most matters to the discretion of the state legislatures, and obviously says nothing about abortion, explicitly or implicitly. But the NYT believes that any law that they find objectionable must somehow be unconstitutional, so "penumbras and emanations" must be discovered to strike down the offensive laws. It is typical anti-democratic, Leftist arrogance.
