This is the key point - it's only because the Supreme Court has become a super-legislature that the issue of Mier's "qualifications" and political views have become so paramount. A hundred years ago, a Miers would have been perfectly acceptable to sit on the Court. But now on our side we fear we need a proven conservative only because the courts have become so politicized.
