Obviously I don't know whether he did or not, but I'm almost positive that when x42 lied under oath it was considered a crime.

I read somewhere that some of Libby's notes recovered by Fitz were on a hard drive that Libby thought he had wiped clean. That would be enough for an obstruction indictment. I doubt it comes from his letter to Miller.

That would be dumb, if Libby doesn't know how to do a secure-delete on a computer file.

lying is in the eye of the beholder. For example, if I asked you when did you learn to multiply numbers and you replied "the third grade". Then I pull out a quiz given by your second grade teacher that shows you got multiplication problems correct in the second grade, did you lie when answering my initiial question? Of course not. You were simply wrong when you answered, probably due to trying to remember something that happened so long ago. Let's see the evidence. Libby might be a ham sandwich in all this.

Agreed. And they are generally charged in cases that involve actual crimes. In this case, no one has been charged with "outing" an undercover CIA agent. As a matter of fact, Fitzgerald hasn't even given us official findings concerning her status. That's very troubling.

This really was a junk indictment: After 22 months he charges a guy because he lied about where he got his info from...zzzzzz.
I don't know what Libby was thinking when he gave his initial testimony, but Fitzy didn't really get much out of this. Bring on Michael Luttig on Monday !!!

Fox radio news: Vice-President's Chief of Staff indicted in the outing of a CIA covert agent. He is expected to step down. President Bush expected to make his first substantial statement since making a statement to reporters almost two years that anyone found guilty in the outing of a CIA agent would be fired. (not verbatim but pretty close to their spin.) Anyone hearing this "news" will assume from their reporting that the VP's chief of staff outed the CIA agent and will be fired by the President. I can only imagine what the other MSM are saying and how the sheeple will be fooled into thinking that the Bush administration is much MORE corrupt the Clinton administration...sickening!

I think that would relate more to destruction of evidence and such. If the 'evidence' destroyed is not of that of a criminal act, then you've committed no crime by destroying it. Lying under oath, even if you've done nothing else wrong, is still a crime. There's going to be some padding with any charges. I suspect this is all about getting Libby to cough up some useful information to go after someone else. Failing that, I think he'll plead down to one or two charges (the rest being dropped) and end up with probation or a few months at a country club minimum security prison.

Also, just because no indictment has yet been handed down regarding the "leak", that doesn't mean that no crime was commited; only that there is not sufficient evidence for a conviction thus far. We may never know the details of what actually happened, but let's hope this prosecutor is as fair and decent as his record suggests. Some freepers had previous dug up information about his prior work that suggests he's actually a neutral party. Thus far, his aggressive behavior appears to be in line with how he's prosecuted every other case. I think it's a stretch to jump to the conclusion that he must be politically motivated. Let's see what the guy actually does first.
