The "accusations" were merely a recitation of Miers' own words and actions ... they were never "baseless" as they were well grounded in fact and were "based" on Miers' own spoken words, involvement in IOLTA, and her own writings.
It is a stretch to say that the truth is only true if Senate hearings have commenced. I am trying very hard not to laugh at that, but only because I know that you were trying to be so serious when you posted it.
