That's what worries me about putting up someone like Luddig or Owens, much as I like them and much as they are who I'd of picked, I just don't see the Senate having the spine to confirm someone like that.
The Anti-Miers crowd doesn't seem to understand just how important all those facts are. I wouldn't give a warm cup of spit for how much fight the Senate Republican majority has in it. As far as I'm concerned, assuming they even get out of committee, if a Luddig/Owens type candidate ends up hitting the floor instead of Miers, the majority will have 49 votes at best, and have to really woo a couple conservative Democrats to get them through, and then have to try and bust a democrat filibuster.
The anti-Miers crowd is really overestimating the odds of getting a Luddig/Owens type nominee through the Senate. The weak 7 Pubs in the Judiciary committee made a deal with the liberals instead of standing firm, not giving an inch, and standing on the fact that the Constitution does not allow for the filibuster of judicial nominees. As far as I'm concerned, the Republicans only have a Majority in the House, and hold the White House. The Senate Republican majority is a farce and a complete and total failure when it comes to fighting for the conservative agenda of the majority of the American people.
