I am agaisnt hiring illegal workers to start with . However you cannot allow a company to hire illegals and then claim they dont have to pay compensation because they are illegal.
IMO this company sucks. They hire illegals pay them low wages and then try to screw them if they are injured. Low life bastards should be prosecuted for hiring illegals to start with.

Great. So the taxpayer and other legitimately operating businesses will pick up the tab for workers, paid in cash under the table, and for whom no Workers Comp/Employment Taxes have been paid by the employer of Illegals.
Just one more incentive for an employer to scam the system and hire Illegals.

1) Illegals are just that, illegal. Ship them back to mexico for treatment.
2) Jail any employer that knowingly hires illegals (Economic terrorists). Charge the company for the deportation, treatment of said illegal and run a thorough OSHA inspection. OH, and make sure the OSHA inspector is the one going through a nasty divorce and got cut off in traffic on the way to work, spilling hot coffee all over his lap.

OK, we have documented evidence recorded in the Court that businesses hired illegal aliens who ended up getting hurt on the job. Why won't the Government prosecute and fine these businesses for hiring illegals?

I think I will go to all of the local worksites here in FL and put up a flyer stating that CA courts have ruled that illegal aliens can now collect workers compensation. Maybe with any luck we will have a mass exodus here. The taxpayers of CA will soon find how how much money in fraudulant claims that they can add to their monthly "illegal alien bill". Looks like alot of hard working tax paying CA residents will be looking for a second job just to subsidize people who have no business being in this country.

Good. It's about time felon employers ante up the costs they are responsible for helping illegals inflicting. Walmart's having been sued for OT & back wages, now this - maybe the liberal courts can be used for some good. Now, if they'll swing around and prosecute the employer on applicable felony charges we'll be making further progress.

A company pays into Workers Comp based upon the claims made against it, this is why the coffee company fought this guy's claims.
Therefore, it isn't all bad that IA's can collect Work Comp, because now the company has lost one economic incentive to hire the undocumented worker.

Earlier this year I argued that THE issue of 2008 would be a triumvirate of illegal immigration/judicial activism/and terrorism, all related. This falls in line completely with that thesis. Here are judges giving illegals workers' comp. The people will pass a law prohibiting this, and the judges will overrule.
At some point, I think that a judge will somehow restrict either Homeland Security or the Border Patrol and that in some way that's going to allow in a terrorist with a dirty bomb. Literally, all hell will break loose.
The only candidates with a hope of winning in 2008 are those who are on the right side of the illegals debate, but this will also touch on judges who rule the right way.

Illegal aliens are found in every city, town, and village in America. Only citizen groups can root them out and turn them over to authorities.
If you still have doubts about the negative effects of multiculturalism, look at England, Germany and France.
I'll award a silver star to anyone who can name a single country in the world, anytime in history, who has benefited from a mixed culture.

IIRC, this isn't the first court to say this. I believe the last time something like this was posted on FR was 3 or 4 months ago and it seems to me that the court was in the SE US.

The second worked TWO DAYS before "smashing his finger", he did not see a doctor as ordered..but claimed his finger "will never be the same"..he is now drawing workers comp until the matter is settled.
The third one has called in every other day now because his "back hurts"..the claim is not far away.
Yet..my employer still thinks Mexicans apply here to WORK.
