Petition for the Withdrawal of the Nomination of Harriet Miers to the U.S. Supreme Court

WE ARE REPUBLICANS AND CONSERVATIVES who supported the election of George W. Bush in 2000 and 2004. Today, we respectfully urge that the nomination of Harriet Miers to the United States Supreme Court be withdrawn.

The next justice of the Supreme Court should be a person of clear, consistent, and unashamed conservative judicial philosophy.

The next justice should be a person of unquestioned personal and political independence.

The next justice should be someone who has demonstrated a deep engagement in the constitutional issues that regularly come before the Supreme Court — and an appreciation of the originalist perspective on those issues.

The next justice should be a person of the highest standard of intellectual and legal excellence.

For all Harriet Miers. many fine qualities and genuine achievements, we the undersigned believe that she is not that person. An attempt to push her nomination through the Senate will only split the Republican party, damage the Bush presidency, and cast doubts upon the Court itself.

Sometimes Americans elect Republican presidents, sometimes we elect Democratic presidents. Whatever the differences between the parties, surely we can at least agree on this: Each party owes America its best. There is a wide range of truly outstanding legal talents who share the president’s judicial philosophy. We believe that on second thought President Bush can do better — for conservatism, for the Supreme Court, for America.

If you are ashamed of Frum's petition...

You would really be ashamed of Ann Coulter's appearance on Hannity and Colmes tonight....jeez louise...talk about over the top!!!!

She is honest though...she made it known that Miers could

give a virtuoso performance in the hearings...and answer every question "correctly" and she will still be embarressed that she is on the Supreme Court...

What makes be embarrassed for Coulter is...she said that she is "mad at President Bush for MAKING HER have to say bad things about Miers"...and that she is starting to feel sorry for Miers, because they "have to say bad things" about her.

THAT sounds like a bunch democrat crapola that she spewed! Blaming Bush for making her do something that she is CHOOSING to do!!

I have NOT even taken a side on this....I don't know...BUT, I will say this much.

The over the top Conservatives are losing me...fast!!!!

Yeah. We're in big trouble. This is where too much compromise leads. If you make power trump principle, pretty soon you have a crisis like this one.

Maybe GW ought to invite Teddy to the Whitehouse to watch a movie and ask him what he would do? It worked before with education reform and the 'no child left behind' act? (sarc/off)

It's time for GW to be a leader IMHO........

of course not, but others may not be so forceful in making their opinions known after being browbeat with attacks similar to those i named above. things like that only encourage me to speak out more, but i cant speak for others.

perhaps your criticism would be warranted if it were limited to a small minority, but our feelings are echoed by numerous pundits/legal minds/etc mark levin, rush limbaugh, ann coulter, laura ingraham, david frum, george will, robert bork etc etc etc

they're all a bunch of "dummies" who know nothing about conservatism

since she has no record to go on we're left to our own devices in determining her overall philosophy--the main points that are cause for concern are the support of affirmative action for dallas fire department and the creation of a womens studies (read feminist) lecture series at SMU in the late 90s with such speakers as steinem and pat schroeder (who tried to weaken our military with tailhook).
anyone who has taken women's studies courses at a university know how they're filled with marxist feminist thought, hate men, hate marraige, "keep your laws off my body" , "its a woman's right to choose". my girlfriend in college was required to take a "women's studies" course and we laughed at some of the propaganda they tried to shove down her throat.

None of us can possibly know that for several years. Even O'Conner was a reliably conservative vote early on in her tenure on the bench.

William Rehnquist had never been a judge before his appointment.

Everyone here who is drawing lines in the sand and saying definitive things about Miers is just full of it. History has proven repeatedly that supposedly "safe" choices turned out the opposite, and that relative unknowns have turned out to be great selections.

Any declaration today is pure conjecture, and the only mistake might have been assuming that conservatives would wait until enough facts were known to make an educated guess.

I'm sorry, but I don't think you can blame those two on this White House. We should have become energy independent a long time ago. Secondly, the projections are a 50% rise in heating cost; that you can lay at the feet of Katrina and Rita.

BTW, George Bush was not responsible for the earthqake in Pakistan either.

For goodness sakes....if you want ego...you should watch Ann Coulter...who feels like you do!!

She is a bundle full of the most ego-filled BS, I have ever seen..

She just said on Hannity and Colmes that she is "embarrassed that President Bush has put US in the position the WE HAVE to say bad things about Miers"!!....

IOW..she is blaming Bush for making her do something that she is CHOOSING TO DO...and quite childishly, also.

When Hannity asked her if there is ANYTHING that Miers could/should say that would even give her a nanteenth of a chance of being acceptable in Coulter's eyes...Coulter said NO..nothing, I am ashamed of the pick!!!

No, you're not, at least not limited to the stuff that's been revealed so far. You'll get to hear her answer live questions, many of them posed by people who will vote against her no matter what, on live television. That will be far more revealing than what contributing a few bucks to a lecture series at her alma mater indicates.

I think most conservatives wanted a bloodbath on the senate floor as we did an anti-Bork on the Democrats. I know I did.

That's probably not going to happen unless the Democrats fear the confirmation of an evangelical Christian. But they won't have to do that if they can be content in the knowledge that conservatives will self-destruct without much evidence to support her confirmation one way or the other prior to the hearings.

Yes, however, Rehnquist had SCOTUS experience and, while there, in his early years, was provided with a continuous education in regard to constitutional law (served as a law clerk for SCOTUS Justice R. Jackson). As a clerk, Rehnquist was an apprentice, an internal, behind-the-scences observer to the SCOTUS. It goes without saying that Rehnquist had a depth of background and experience with constitutional law not, by any stretch of the imagination, matched by Miers.
