Businessman charged with secret taping By EMILY C. DOOLEY STAFF WRITER
SANDWICH - Police arrested the owner of a massage parlor Sunday on wiretapping charges after they discovered he had installed video cameras to spy on a woman living next door to the business.
Patrick M. Dwyer, 40, of 3 Fuller Drive in Plymouth, was being held at the Barnstable County Correctional Facility.
Dwyer is scheduled for arraignment in Barnstable District Court today on six counts of wiretapping, three felony counts of breaking and entering a building in the daytime and one count of possession of marijuana.
The alleged victim called police Sunday after she heard a noise in the attic of her Merchants Square apartment. When police investigated, they discovered a hole in the walls separating the Balanced Body Center and the victim's apartment, Sandwich Police Chief Michael J. Miller said.
The Cape Cod Times' Sandwich bureau is connected to the victim's apartment on the other side.
Miller said the police are looking through the tapes and more charges may be warranted.
''We are still working,'' he said.
The building's owner, Jonathan Fitch, could not be reached for comment.
Dwyer is co-owner of the Balanced Body Center, which opened in 1998 to offer massage and personal training. The business moved to its present location in 2000, adding services like facials and tanning. A year later, a yoga studio was added, according to the company's Web site.
For a time, the business also hosted Music Together, an early childhood music development program for infants and toddlers up to age 4.
Dwyer owns the business with Paula Monroe, who could not be reached for comment.
Martha's Vineyard electrician and wiring inspector Richard Lehman killed himself last year after admitting to placing a camera in a female tenant's bathroom.
At the time, Lehman could not be charged because there was no state law against videotaping another person without their consent. But a new law, enacted in February, prohibits such activity.
A conviction for wiretapping under the new law is punishable by up to 2½ years in a house of correction, a fine of up to $5,000 or both.

A very good friend of my wife and I got back to her apartment the other day and thought she heard something in her upstairs crawlspace. She grabbed her phone and called 911, while on the phone she saw the guy next door heading to his car. The police showed up while she was yelling at the guy, cops search her attic and find a hole leading to his unit. Then the cops search his apartment and find tapes of her, lots of tapes. The most recent tape was of the night before (she wasn't home) and showed the guy in her underwear and *holding* her *adult* *toys.* WHEN THE POLICE TOLD HIM HE WAS UNDER ARREST HE CRAPPED HIS PANTS. It was several hours before he was allowed to clean & change.
