AUSTIN -- Dick DeGuerin, lawyer for indicted Rep. Tom DeLay on Tuesday subpoenaed the prosecuting Texas district attorney in an effort to show he acted improperly with grand jurors.
The subpoena for Travis County District Attorney Ronnie Earle, filed in Austin, asked that the prosecutor and two of his assistants appear in court to explain their conduct.
The lawyers, previously had filed a motion asking for dismissal of the conspiracy and money-laundering charges against DeLay, the former House majority leader who has stepped aside from that post because of the indictment.
Dick DeGuerin, DeLay's attorney, also asked that grand jurors be released from their secrecy oath so they could answer questions about the prosecutor's conduct.
Looks like Ronnnie Earle messed with the wrong Texan this time. DeLay has a great attorney and I expect this to blow up in the Dem's faces.
Fight fire with fire. It's the only way.
Brit Hume's show talking about this now. Also saying Earle's son Jason is planning to run for office in Austin. His daughter may run for his DA slot whenever Ronnie decides to step down. "Beginnings of an Earle family dynasty" is how it was described.
Lots of pointed questions in the subpeona. There would need to be a judge that would order Earle to sit for questioning on this, unlikely according to Brit and reporter of story.
Delay for President.
Yep...sadly, it appears that only a judge can force this DA to sit for a deposition and answer the 12 questions that Delay's lawyers have for him. As even Hume admits, it's unlikely long shot.

DG: Earle always gets that 'ol saw out when the subject comes up. Fact is Earle prosecutes conservatives and people he doesn't like, .....doesn't matter what political flavor. It's about time to put a stop to it once and for all.

Exactly, and a good one! Delay doesn't care if the guys a liberal or not, if he can kick butt in the court room that is all that matters.

The real change needs to take place in the Texas Legislature and Constitution [whichever or both] whereby the Travis County DA has this authority taken away from him and given to the State AG, imo.
This won't change a thing about the DeLay indictments but will change the future ones.....

I love Tom Delay. And the whiney spineles "conservatives" should take a lesson!!!!
It's about time a R went on offense.
It is certainly unlikely if the judge is your typical Travis County liberal judge.
But one thing I do know. If I wanted to hire the best lawyer in Texas to represent me, I'd hire Dick DeGuerin.
All have to clearly state...is leave the man(Tom Delay) alone ...unless there is any evidence of any kind of fraud caught on tape.
By the way does'nt the country as well as the world have plenty of work to do? I guess the Captial Hill libs are too bored..... they need more work to do.
So please call any libs on the Hill and tell them Habit for Humanity needs help in building homes for famlies in need ...I bet President Carter would appreciate the help.
