Former Black Panthers jailed for refusing to testify in 1971 case (murder of policeman)

SAN FRANCISCO – Two former Black Panthers have been jailed – one for a second time – after refusing to testify before a grand jury about the 1971 killing of a police officer.

Richard Brown, 64, was ordered in jail Friday after San Francisco Superior Court Judge Robert Dondero found him in contempt of court for refusing to answer the grand jury's questions.

Two days earlier, a fellow former Panther, 62-year-old Ray Michael Boudreaux, was jailed for a second time on the same charge. Boudreaux had spent three weeks behind bars before the state Supreme Court ordered him released Sept. 22 because of procedural errors by Dondero.

Prosecutors reopened an investigation after nearly 30 years into the murder of Sgt. John V. Young, 51, on Aug. 29, 1971. A civilian clerk also was wounded when two men burst into a San Francisco police station and fired a shotgun through a hole in a bulletproof window.

Three men were charged in the attack in 1975, but a judge dismissed the charges a year later after it was determined that one of the suspects was tortured into a confession.

One of the men previously charged in the case, 57-year-old Harold Taylor, as well as 70-year-old Hank Jones, both have been in jail for nearly a month after being held in contempt.

The grand jury also is looking into the Feb. 16, 1970, bombing of another police station that killed Sgt. Brian McDonnell, 44, and injured eight other officers. No one took responsibility for either attack, but authorities always have assumed that radical groups were involved and that the two incidents were related.

At least a dozen people have been subpoenaed and offered limited immunity from prosecution in exchange for their testimony.

Defense lawyers have argued that the questions violate the men's constitutional rights to freedom of speech and association. Several have filed appeals to the state Supreme Court for their clients' release.

Boudreaux's lawyer, Michael Burt, called the questioning unfair.

"These are all guys who, back in the '60s, were involved in one way or another with the Black Panther Party, and most of whom went on to lead very productive lives," he said, adding that the subpoenas and interrogation "came out of the blue."

Burt said his client refused to answer questions mainly because he wanted complete – rather than limited – immunity from prosecution for his testimony.

Hmmmm...wasn't this the same logic used at the trial of the elderly KKK members for the bombing of a black church in the 1960s?

She moved on to Yale Law School in 1969, which was a hotbed of activity on behalf of the violently racist Black Panther organization. She writes that, “The world and its realities came crashing down on Yale in April 1970, when eight Black Panthers, including party leader Bobby Seale, were put on trial for murder in New Haven. Thousands of angry protesters, convinced the Panthers had been set up by the FBI and government prosecutors, swarmed into the city. Demonstrations broke out in and around campus. The campus was bracing for a huge May Day rally to support the Panthers when I learned, late on the night of April 27, that the International Law Library, which was in the basement of the law school, was on fire. Horrified, I rushed to join a bucket brigade of faculty, staff and students to put out the fire and to rescue books damaged by flames and water.”

So Living History portrays Hillary as someone who didn’t participate in the pro-Panther demonstrations but just tried to save some books from a fire.

Panther Justice

Former sixties radical David Horowitz says that both Hillary Rodham and Bill Lann Lee, who later became President Clinton’s head of the U.S. Justice Department’s Civil Rights Division, helped organize the pro-Panther demonstrations at Yale. Others sympathetic to Hillary contend that she was merely among a group of law students who monitored the trial on behalf of the ACLU, which was concerned that law enforcement was violating the civil liberties of members of the party. But Hillary says nothing in her book about even this role.

What is not in dispute is that she served on the Board of Editors of the Yale Review of Law and Social Action, a “progressive” alternative to the school’s traditional review, and that its fall 1970 issue was devoted to the trial and glorifying the Panthers.

The Red Lawyer

During the summer of 1971, Mrs. Clinton writes in her book, she was a law clerk at the Oakland firm of Treuhaft, Walker and Burnstein. “I spent most of my time working for Mal Burnstein researching, writing legal motions and briefs for a child custody case,” she said. In fact, however, the public record shows that Clinton worked for Robert Treuhaft, a member of the Communist Party USA (CPUSA) and Harvard-trained lawyer for the party.

Citing public sources, Peter Flaherty’s book, The First Lady (Vital Issues Press, 1996), says that “Hillary was recommended to Treuhaft by some of her professors at Yale. She was looking for a ‘movement’ law firm to work at for the summer. As it turns out, Hillary would continue her association and support of the Black Panther cause while working as a law clerk for Treuhaft.” Flaherty notes that Treuhaft told Herb Caen of the San Francisco Examiner, “That was the time we were representing the Black Panthers, and she worked on that case.”

Hey you want to get just as ticked off, read this article my brother just emailed me. Kid in England stabbed to death for absolutely no reason, the video is on the bottom...The one who did the stabbing got 15 years, the other two got 5 years. Un-freggin`-real! Blatant murder caught right on video, and they get 5 freggn` years?
